As far as living back in the US I don't think we will ever do so.We will just go for tourism reasons

As for why those rich people get married not in the Philippines, I guess it's related to the lack of divorce. Also, getting married in a church will require a ton of docs plus may be feeding some mouths

It looks like I'd have to get married first (Civil) then book an appt with the US Embassy and go from there...

Before I book the appt, don't I need anything for the Criminal record from the US or may be the NBI here? Any birth certificate or is just the passport enough?

your post is confusing. Again she can not get a visa k-1 0r the spouse visa and live in the Philippines. A tourist visa for her is most likely not going to happen.

the appointment from the embassy is that you are free to marry you will need passport and if you were ever married before your divorce record

Sorry if I confused you. I think he title says a different thing now than what I am supposed to do.

It looks like that I'd have to do a DCF (since we both reside outside the US) then get married in some Filipino civil court (some 10 days).

After that, I should be applying for a K3 visa so she could visit the US.

We don't intend to living in the US. We will just treat it as a tourist destination.

I do not believe you understand the visa process at all. she can not get a k-1 fiancée visa or k-3 or IR-1/CR-1 spouse visa and live in the Philippines. To do that she will need to get the cr-1 visa and become a Us citizen If not she will have to stay in the USA a certain amount of time each year

If your plans is to live there and visit then a tourist visa is what is required. However with her being a single female in the Philippines the chances of her getting a tourist visa are slim to none it just is not going to happen

Yes a US citizen living in another country can bring his wife to USA to visit. To do that his wife will need to get a tourist visa. To get a tourist visa his wife will have to show strong ties to her country and that she has no plans to stay in the USA.

However with the Philippines being a poor country and with her being a female, That is going to be hard for her to prove, that she will come back to the Philippines, which is why most tourist visa from there are deny especially for a female there

Being married to an American citizen will actually hurt her chances to get a tourist visa as it shows she has a reason to stay in the USA and not return

You could still get married apply for IR-1/Cr-1 visa thru DCf then live in the USA till she get her American citizenship then you and her could go back to the Philippines and live. The Philippines will allow her to have dual citizenship

the drawback is that she like you will have to pay USA taxes on any income she makes over there

She can not live in the Philippines. You can not get A k-1 visa come to America get marry and go live in another country. then go to USA whenever you want to visit

That's what I had thought too. To get a K-1 visa first.

However, a K-1 visa required the US Citizen to be residing in the US during the whole process which I am not. So, I was introduced to the DCF filing which allows those US Citizens who live outside of the US to get married.

The issue is, if a US citizen gets married to a foreigner (in my case a Filipina) outside the US he won't be able to have her (with him) just to visit the US unless she applies for a tourists visa. But Filipinos will not get a US tourists visa unless they prove they will leave it back to their country.

She doesn't work coz she don't need to? She can't prove to the Embassy anything since she has none of their requirements so, she must now get a US residency (be a US resident) just so she could visit the US

This will require me too to live in the US while applying for her residency!

Heck, isn't this my right as an American Citizen to bring my wife for a visit without me having to follow some impossible to implement rules?

I guess I'd have to re-think this....

If you were a non usa citizen you could get a work visa and easily bring your wife here.

I knew a guy who was retired in Philippines and wanted his wife to be able to visit USA. He got a greencard and after a while they went back to Philippines and she turned her greencard in to the US embassy in Manila.

Later she applied for a Tourist VIsa and it was granted and CO said it was cause she had previously turned in her gc.

A lot of work to get a tourist visa....

As I said, the problem seems neither one of us wants to reside in the USA. We just want to visit. I am American and I think (now I doubt it), I would have the right to bring my wife (the one who was approved for marriage by the US Consulate!) to the US for a visit?

Otherwise, by having the US approve my marriage outside the US (by a US Consulate) they are saying a married American can NOT bring his wife to the US for a visit unless he resides in the US and his wife stay out while he applies for her.through I-130!

It's like forcing people to lie to the US government so they could visit the US
