CSPA Applies.....Now What?

Child’s Date of Birth: 11/04/1991
Date Immigrant Petition Filed: 07/16/2002
Date Immigrant Petition Approved: 10/13/2009
Date Immigrant Visa Becomes Available: 05/01/2015

Length of time immigrant petition was pending: 7 Years, 2 Months, 28 Days
Age of child on date immigrant visa becomes available: 23 Years, 5 Months, 27 Days
Age for CSPA Purposes (Age at the time immigrant visa became available minus the length of time immigrant petition was pending): 16 Years, 3 Months, 0 Days
Age of child now: 23 Years, 5 Months, 20 Days

As the age of the child is considered to be 16 years and 3 months when the visa becomes available for CSPA purposes, I believe he is eligible for a visa as well.

The NVC only sent the “Immigrant Visa Application Processing Fee Bill Invoice” for the applicant and her spouse. How do I go about having them sending an invoice for him as well?

Was the child's name included in the i130?

Yes, he along with his two older siblings.

CSPA no longer applies for them, but it easily does for him.

An email (attach a copy of the child's Birth Cert) or call to NVC should fix it.

Thank you. Just got off the phone with them. They asked that I send an email/letter with my calculation...ugh. Frustrating because they already have the information and just need to look at their calculation.
