I need very serious advice

Hi everybody, I have a very unique situation, unique because I haven't came across to anybody that has the same experience so I need serious advice about what I should do. So I got RFE for my AOS application it asked for a bunch of stuff and most of them I had no problem providing but when it came to joint sponsor's documents the trouble began.

I sent missing documents for joint sponsor because well I'm stupid and there's no other explanation for that. I sent her form I-864, birth certificate, last 3 years of tax returns(not completed, w-2 is not included) pay stub and employment verification letter. Since I know that completed tax returns or tax transcript is important and I haven't provided neither what are my chances of getting denied or getting another RFE. I know RFE is your only chance to provide all the missing documents and since I failed to do so, this doesn't sound good.

As far as I can see I have two options. One just waiting to see what the uscis will say and risking the denial which I don't want to do so because I have file again and pay the fees etc. the second option is when I called the customer service today, the guy on the phone told me if I have a copy of the RFE letter I can send it with whatever documents I am missing. He said as long as I am not out of the deadline, sending additional documents for RFE should be ok. I am kind of leaning towards that but the problem is on the letter it said send everything all at once and failure to do so will cause denial. Even though I got a word from the representative I am still afraid to do so.... My question is, is there anyone with a similar experience? What do you guys think that I should do? Either way it's risky but I have to do one of them. And If I send the missing documents again, are they even going to look at it? Last question is if I send it what should I say on the cover letter, I can't say something lame like I forgot because I'm sure it will make them pissed. I would really appreciate answers, I'm in the middle of a nervous break down, I can't eat or sleep. I lost 15 pounds over the past 2 months just because of the stress. If I do decide to send I will do it the beginning of next week, the previous RFE documents have been received by them today.

I don't have the same experience but my advice is to send the missing documents expedited with a letter of explanation. If the rep advised to do this, then take that advice. Thats what I would do. Even though the warning advises to send the documents all at once in one package, that damage has been done. To fail to send the required evidence is almost a definite denial. To send now in separate package is the only good option left. Better second package on time than never.

As far as what to write in the explanation, you should keep it simple and straightforward. Whatever common sense answer that will be understood easily. If it is only a missing w2, then you could say that the documents were accidentally excluded from the original package due to miscommunication. I'm sure they are familiar with processing errors and will appreciate the honesty IMO.

Thank you so much! That's what I'm planning to do. My joint sponsor lives in a different state so she will mail me those with priority or express mail and then I will express mail everything with a cover letter. By the latest next week they will receive it and hopefully it won't be too late.

I think you could save some time by having her email you copies for print. W2 does not need to be an actual original.

I have just asked her to do that. And if I express them tomorrow it would be there on Saturday. Is there going to be anybody there on Saturday? Because with express mail, signature is required. It's kinda stressing me out it won't be on a weekday. What do you think?

Yes that is stressful. If there wont be anyone there on Saturday, they would go back to deliver it the following Monday. I'm pretty sure the government processing centers are off on the weekends. Otherwise, you could wait until Saturday to go to the post office and then overnight it. That way it won't be delivered until Monday morning. Ya know, so's you don't have to sit in suspense waiting for the delivery and worry about the possibility of the package getting mishandled. I'm also a worrier and I understand the preference to do things in a more certain way.

You are right. With this process for almost going on for 4 years every little thing stresses me lol. I can't help it. The joint sponsor decided to mail them through priority mail today because some of the attachments are not readable when you scan them. So I'll receive it on Monday and mail it on Tuesday and they'll receive it on Wednesday.

What's your experience with USCIS? Are you in green card process? Me and my husband married for almost 4 years ago, hired an attorney in 2011 and in 2013 we found out nothing in our name has been filed, because the lawyer had some drug related charges and lost her licence. So I decided not to hire an attorney anymore and do it all by myself, in 2014 we sent everything but the money order was too old so I got rejected. Fast forward to march 2015 I sent my package and last Thursday I did the biometrics since they sent RFE everything was on hold, but now that I sent the response and will send an additional one next week, I'm hoping there will be some process soon and I'll get my EAD card. It's just years of patiently and nervously waiting but hopefully it will be worth it :(

Ur mail should be there on Saturday but uscis employee will pick all ur documents on Monday or tuesday. From my experience

Oh goodness! Thats awful. I'm sorry. Attorneys are such good actors and its so easy to be taken in by a bad one. I simply couldn't afford to pay the fees for one, so I did everything myself but it took forever. I was so worried about getting an RFE or getting outright denied that I waited until after 1 year from my marriage to send my CR1 (i-130) petition in to USCIS. I didn't go with the fiance visa because Nepal is so far and I couldn't afford to visit him in person. I finally decided to just move to his country to marry him 2 months after we met so we could live together while we filed for the spousal visa. It was difficult for me to adjust to living in Nepal so we moved together to Dubai, but that was even harder. I moved back to the US and returned to my previous employment after living with my husband for only 6 months. I think my case looks suspicious to an outsider and we didn't have much evidence from living together abroad, no joint accounts or leases etc. so I went through hell getting the petition in order. Mainly all I had was piles and piles of correspondence, pictures together, plane tickets and western union receipts. I did a lot of painstaking research and made an explanation of my entire situation for each section of evidence. I have kicked myself so many times for taking so long to finish it but I try to think it was all worth it. My experience with USCIS was typical and the petition was approved without issue in the average time of 5 months. Its been 1 year and 5 months now since I returned to the US alone and lived separate from my husband.

I have a friend that was doing her hubby's AOS. First time she tried to get a waiver. Got a denial letter and said send the money. Second time RFE, need joint sponsor. It took a yr, but he got his green card. Hope it works out for you. Make sure you put his A# on anything you send.
