Look at the instructions for form I-864W it explains the exemptions to filing I-864

The petitioner is always the sponsor, and I-864 is required to be filed when adjusting status.

If you are talking about a co-sponsor, the petitioner needs to make more than 125% of the poverty line when counting self, any dependents and the immigrant being sponsored, if using assets to make up a short fall from the 125% poverty line, the assets are counted at 1/3 value.

so would my wife be the sponsor and her mum the co-sponsor?

or can her mom be the direct sponsor?

And what is in case of a divorce? I am sure her mom would not be happy if she has to sign something that states that she has to pay for me for 10 years in case of a divorce?

My fiance is not able to directly sponsor me, but we would need her mom as a co-sponsor.

Whats the difference then to taking her mom as the direct sponsor? whats the effect on her?

What would you suggest?

Your fiance will always be your primary sponsor.

I really recommend to read all the instructions with the papers and here on the webpage carefully, most answers are there. Check each thing over and over before you send it off.

There is no such amount. The law says that you need a sponsor without regard to how much money you have.

The only way to not need a sponsor is to already meet one of the requirements for ending the sponsorship. As a practical matter only 1 of the 5 ways will do - you must have already worked 40 qualifying quarters in the USA.

Precisely so and that was my assumption as well. But there are different requirements depending on where you live, your job, number of dependants, number of people you are sponsoring.

Your mother-in-law can be your joint sponsor. I don't know about being a co-sponsor though. Does she live with you guys? Anyways, my mother-in-law was my joint sponsor. She doesn't live with us. My husband was my primary sponsor. They each filled out the I-864 form, and turned in tax returns, W-2s, 1099, pay stubs, and employment letters. Hope that helps. Good luck.
