he now says he is not an attorney so he can't speak too much about deeds or titles. but when he was telling us we *had* to select that option, he sure thought he was...

oh and he says that there is no way i can be on the title until after we purchase the house and only then we can contact an attorney to add me on there. :lol: omg i feel like i'm in a bad bad dream...can't wait to wake up!


honestly, the people who are to blame are ourselves, for not being informed enough, for not seeking legal representation from the beginning, for thinking we could pull this off by trusting people who seem to know what they are doing. well, we know better now.

Well, he's an agent, he should have a broker that oversees all this.

As far as the law goes, the title is not recorded until after you close. At which time, the title company can add anyone to it. I don't know how it works over there, but it can't be far off than here.

How can a new owner be recorded as the new owner of the property before the sale is finalized? The old owner didn't even get paid yet.

Anyone can be added on prior to the closing.

i think he meant that there is no way to add me to the title as a non-borrowing spouse unless my husband *later* chooses to get me added. but as niki's experience shows, of course it's possible to get it done at closing. the notary said if i want to be added on the deed before we close, the papers need to be re-drawn, which will take another 2-3 days. not gonna chance that.

the escrow company (based in california) took 2 and a half days to get the documents drawn up. i called the escrow company to ask why it took so long, on the advice of our loan officer. the lady said that our loan officer had no right to tell us it would take 3-4 hours, as that is not her timeline to comment on. she said this is "normal" turnaround time. we didn't choose the escrow company, it was recommended by the seller/bank's asset manager.

Geez, what a nightmare. :( Our closing was so lowkey, easy, and they could have easily changed all the documents that minute had they wanted to. That I guess is the difference between small town lawyers as closing agents and having all these bigger companies involved.

No wonder everything is azz backwards over there.....

Why isn't your own lender holding the escrow? What escrow are you talking about? Tax and insurance? Or unsettled items in the contract? Any attorney can hold that escrow.

The only time there should be an out of state company involved is when you're doing a property exchange, and you need a qualified intermediary.
