The buyers for my dad's house I think had to close a month after our original date or so due to the bank taking forever to get the loan documents ready.

And Brat, the seller (the bank seller), you can't tell me that they're not willing to extend the contract. I doubt they'll cancel it on you. If the delay is only a couple of weeks. they will go with the "definite" resolution, rather than "may be" by putting the thing back on the market. Unless they already have a back up offer from a cash buyer whom is ready to close.

steve, you know i always appreciate your advice. but in this case, we have already given our notice to our landlord and in good faith, we will leave when we agreed to. hubby's parents have graciously agreed to let us store our things in their workshop, just gotta find a place for us + cat + hamster to live until then.

this is the 2nd time we are missing the closing date. the first time around, the seller/bank denied the loan officer's request for an extension (that she did not even tell us she was applying for) and if we had not submitted a second offer and had that offer accepted, then i suppose the house would have just remained on the market (there were no other offers). i have no hope that they will magically decide to grant the extension this time around.

If Kat decides to FU, and not buy the house anymore, does she have to pay anything?

my (limited) understanding is that there is a clause in our contract that says if the sale falls through because of financing and not because we failed to do our due diligence in obtaining financing, then we do not owe anything, including the earnest money deposit. we did not pay for the appraisal upfront (it's part of closing costs) so i'm not sure if we would owe that. at most i guess we lose the house inspection fee (not a huge amount) and time.

although, our first earnest money deposit has not been returned from the first offer we submitted. i remember we signed a form and said it would be refunded, but it has not been, so, i guess, we are possibly out both earnest money deposits? will ask the listing agent today.

ok, that depends on the contract. Most of the time, if you fail to close, because you change your mind, the seller can keep your deposit (usually 10%). Furthermore, they can sue you for "specific performance" to fulfill your contract. But the latter, rarely happens.

Most of the time, the seller are the ones to change their minds.

forgot to add.....if the buyers fail to close due to no fault of their own, then they are entitled to the deposit back. The inspection fees, appraisal, etc, are not recoverable. It's money spent.

I really don't know how deals are negotiated over there. But these buffoons would all be out of business over here.

Inside 30 minutes, I'd have this thing all settled here.

Well, of course, but it seems that the bank had some valid reasons to be concerned about them, they had a low down payment loan, can't remember if it was FHA or VA, but they really had to scrimp and get some gifts from family to get that deposit.

According to our closing attorney, they seem to have a huge case of buyer's remorse and can't afford the carrying costs of the house and have been harassing the closing attorney for the past year over some money put into escrow for radon remediation. :wow: Too bad, so sad, but only an idiot wouldn't realize that they need to budget for repairs (that they actually acknowledged needed to be done in writing before the sale) and utilities, etc.

So far, I am able to eliminate 4 dates from that riddle.....

May 19, June 18, These numbers only appear once, they can't be what she told Bernard.

July 14, and August 14. These numbers appear twice, but in different months. So it can't be what was told to Albert....


That leaves 6 dates......

(The amount of dates it takes Tarklar to get to first base.......)


So now tark can guess at the 6 dates and have a 5% chance of getting it right :) right?


but I'm trying to do homework with the kiddo here.....

hmm...spate of bad luck continues. jonas and i were rear-ended in a hit and run about 40 minutes ago. we are completely unharmed and the car has minimal damage (thank god). policeman was amused that i had the guy's license plate, description of car, exact time of the hit and run and a picture of the guy snapped with my phone lol. still not sure that we want to press charges though. policeman said he is going to drive by the guy's residence and see if anyone is home.


what can i say...i am a cynical singaporean to the bone. jonas kept saying "yes, i am sure the guy is going to pull over."


nope...off he drove.
