Well, good news and bad news. My case was updated, but it's an RFE.

Aww man! Well atleast you know know that yours didn't get lost . I hope its easy to fix though.

Yes, that's the good news out of it. I am sure yours is going to be very soon now and I hope you have better luck! The only thing I can possibly think of is if they are going to ding me on the IMBRA thing. I answered it exactly as asked, but maybe they want proof.

The amount of time you wait doesn't mean you will get a RFE or not. I was following another couple who just got NOA2 2 days ago, and their NOA1 date was 3/19, no RFE. So you really don't know until it's processed. Good luck!

Met on Elena's at the end of 2012, have met in person 3 times. I did email them prior to sending and they stated they do not fall under IMBRA. There are also posts on VJ about it and others were fine putting exactly what I did. Hindsight I should have included that email, but who knows, it could be for something else entirely. Just have to wait for the letter now.

Nope. We will call the NVC on Monday!

K1 visa process:

06/01/2013: first met

03/29/2014: started dating

12/31/2014: "engaged"

04/14/2015: sent the package

04/17/2015: NOA 1 (CSC)

05/11/2015: "document returned to USCIS" (NOA1 hardcopy)

05/13/2015: called USCIS

05/28/2015: e-mail: they will mail the NOA1 hardcopy again

06/01/2015: NOA 2 !!

06/06/2015: NOA 2 hard copy

06/08/2015: NOA 1 hard copy (finally...)

06/25/2015: embassy received electronical file

07/16/2015: embassy received physical file

07/17/2015: embassy sent pack 3

currently: waiting for pack 3

I just received my RFE in the mail. Here is what it says exactly:

"You, James ___ (the petitioner), filed a Form I-129F, Petition for Alien Fiance(e), in behalf of Julia ___ (the beneficiary) on April 06, 2015. You are seeking to classify the beneficiary as the fiancee of a United States citizen under section 101(a) (15) (K) of the Immigration and Nationality Act. Additional evidence is required to establish the qualifying relationship. Submit your response to this request for evidence along with the attached blue sheet.

International Marriage Broker (IMB)

You answered YES to Part 2/Item 35 indicating that you used the services of an international marriage broker. Accordingly, you are required to submit a copy of the signed, written consent form the IMB obtained from your beneficiary authorizing the release of your beneficiary's personal contact information to you. The form that you submitted as evidence of the beneficiary's consent is not acceptable as it is blank and does not have beneficiary's name and or authorization to release her information to you, the petitioner."

So is this really a two-part RFE? First they are asking for additional evidence to establish the relationship, and secondly they are saying the consent form that we submitted is unacceptable?

It does sound like a two-part RFE. For the first part just flood them with everything you have, especially primary evidence. The second part maybe you can contact the agency and see if they can help, they should know what satisfies USCIS. They said it was blank, maybe they missed something when they were reviewing it. I'm waiting for my RFE now, sucks how much it's slowing things down. You still going to Ukraine later this month? Good luck!

The RFE isn't specific on which part(s) of the consent form are blank, but I'm guessing they meant the spot on the bottom of the page where it says "I agree to give my contact information to ". Instead of writing in my name, that spot is blank. (It should have been obvious the form is for me because my name and signature are at the top of the form, but anyway.) Also she only signed the form (not print), so that could be an issue too.

I just had a chat online with one of the VJ immigration lawyers. He said I should just fill in the spots that are incomplete, resubmit, and that should work. This makes me really nervous though because the whole point of the form is to have it completed properly before contact information is given. Obviously that didn't happen if we're making changes now. I'm concerned it will cause our petition to be denied. But it's our only hope at this point!

Yes, I just bought my airline ticket today actually, and I'm going back to Ukraine on June 29th and staying for 10 days. (Hopefully the ongoing war with the Russian backed separatists won't get too much worse between now and then!) This should definitely help establish our qualifying relationship, and we'll take plenty of photos. Then when I get back home, I'll respond to the RFE, and include the new photos, Viber chat log, a copy of the receipt for the engagement ring, and some other evidence of our relationship that wasn't included with the original petition!

I am also now waiting for the RFE to arrive in the mail. I do wish they would give you some type of heads up in your email at least as to what they want. I also have no idea what they need because I followed all the guides on here. I even had a friend who recently went through the K1, look it over before sending it off. I hope that our RFE's are something easy to address so that we can submit the additional evidence and keep the ball rolling. I am happy that at least our files are on someone's desk just awaiting our response for quick approval! Keep us posted on your RFE and I will do the same!

Will do Kim&Jules will post as soon as I get it. Hopefully for all of us going thru the RFE game it will be quick and easy. :dancing::clock: Have a great weekend all :goofy:

I think that is all you can do as well. I understand your concern because that is how logic works, but logic never seems to play a part in this. The whole IMB thing is ridiculous. I was really tempted to just say we met on social media site somewhere instead of the actual site, but I was playing it honest. The site I used wasn't an IMB, but it wouldn't surprise me if that is at least one of the questions I get.

That's great you are going soon, at least you have that to look forward to. I am hoping to go back in August, have to see how everything shakes out first. You should have lots of evidence after that, of course the boarding passes and passport stamps are important. Good luck with your trip and keep us posted!
