Hello! I already did my biometrics yesterday. How long after biometrics that you'd know you have an RFE? I'm really anxious to know if I have an rfe or no rfe already.

Congrats guys to those who landed jobs! I, too had two phone calls and I've my hands on exam tomorrow. I hope they'll accept despite the fact that my EAD is still on process. I'd like to work already to help my hubby.

The RFE's can happen at any moment in time during the AOS/EAD/AP application process. I have also read about other fellow VJ members receiving RFE's just about 1 week or so after their Biometrics. I hope that we all are RFE free during the AOS journey.

Most of RFE's I've seen is more evidence to prove that the USC has reached the income requirement to support the foreign spouse.

I would say that a typical RFE would be for not having an I-693 form completed if the medical exam (expired) was done over 1 year before entering the US on K-1 application/consulate process. Another more common RFE would be in regards to the I-864 affidavit of support due to insufficient income to meet the USCIS requirements. (Joint sponsor will be needed)

Others might be for evidence in regards to the latest Taxes for the current year and or IRS transcripts. If filing for EAD/AP simultaneously, you might get an RFE if you didn't include the 2x2 photos required but it varies per case.

By this do you mean that they had filed and were under the required income or that they had filed and were on/or only just over the required income so they sent an RFE just to be safe?

We are over the minimum income by quite a bit now but my husband is a recent graduate so two years ago he was just making the requirement, as he was studying full time as well as working.

As long as the USC's most recent Income Tax Return shows the minimum income requirement, it should be safe.

Commonly, the RFE comes in when the USC's income met the requirement presently, but the most recent Income Tax Return showed otherwise. In this case, sufficient documentation to prove his/her current income should be substantial enough.

Unless we have made a silly mistake somewhere along the lines, or they don't accept the photocopy of my completed vaccination records then I'm hoping we'll be safe. You never know with this process though!

The DS-3025 photocopy should suffice as long as it is marked with "US vaccinations complete". I scheduled a civil surgeon visit to fill out pages 1 & 5 of the I-693 and transcribe their local US Public Health vaccinations since my K-1 fiancé (wife) and K-2 (step daughter) had their DS-3025 copies unmarked. I didn't want to risk taking chances so I submitted an I-693 for my wife/step daughter's AOS application. It added an additional $150 (civil surgeon form fee) but it was peace of mind in our case!

I told my employer I should get my EAD by end of this month. Now, I am banging my head for not applying to expedite it with my offer letter..

I concur. Hopefully we hear good news from one of our fellow AOS/EAD/AP filers from April?

Congrats once again on that offer. Have you scheduled an infopass appointment in order to attempt an expedite of an EAD for your case since you hold a formal offer?

I can see from other threads having updates, a month after Biometrics. If none, I will follow your advice.

No, we are not allowed to work without the EAD. I have not started yet. Waiting for my EAD
