NBI Clearance: Driving Me Crazy with Paranoia

Hi VJers,

I have just applied for my NBI Clearance today and I have got a "hit". What does that mean?? :(

I had a case before for slight physical injuries when I was 16 but was dismissed and I have the original letter of dismissal from the Regional Trial Court.

Will this reflect in my NBI even though the attorney has stated before that it will not? Will this affect my K1? Oh my, this is driving me crazy!

Any help and insight to this will be greatly appreciated.

FYI: The NBI has an online clearance application. Its so much easier and faster! You can pay via online banking :)

March 6, 2022: N-400 Filed Online

October 20, 2022: Interview (Approved)

November 10, 2022: Oath Ceremony

I130 - Minor Children:

December 20, 2022: I-130 Filed Online

November 15, 2023: Approval Notice

November 19, 2023: NVC Received

December 11, 2023: DQ'ed

September 30, 2024: Interview Letter

November 6, 2024: Medical Exam (Passed)

FYI: The NBI has an online clearance application. Its so much easier and faster! You can pay via online banking :)

Whether it will cause an issue or not depends on the wording on the NBI, there are details in the embassy instructions letter regarding this.

A hit does not necessarily mean that the hit is your old case.

My wife and I both got hits years ago. Personally I think the NBI where we got it was just being lazy and had us come back a few days later, where we both got "clean" NBI Clearances (No derogatory record).

You'll just have to wait until the day you are told to come back. At worst, it's your old case. At best, it's similar to ours or may kapangalan ka who has a case or something and thus the hit. (someone with a similar name)

Jan 22, 2015 - Packet 3: Mailed (again via PhilPost!) paper/hard copy delivered to out place here in Manila.

Feb 24 & 25, 2015 - Day 1 & Day 2 of Medical @ SLEC. Immunizations given on Day 2, thankfully

Mar 5, 2015 - USEM Interview Appointment - IR-1 Visa Approved! (CEAC Status updated to ISSUED afternoon of interview day)

Mar 10, 2015 - 3pm - Received SMS saying IV Package ready for pickup at 2GO MoA. Picked up at 5pm. (Shipped/Picked Up/In Hand on 3rd Business Day post interview)

Mar 13, 2015 - CFO Manila - Done

My recommendation is visit a local NBI office near you and get "chummy" with the NBI officer and try and find out what the details are for the "hit". We had same experience and was able to find out it was a past case that never got updated with NBI. My wife had the paperwork from the courts and was able to present it to the NBI for updating. She had to do it after the interview and after she received the 221g because the NBI was never update even thou she presented to NBI the documentation 2 months before the interview.

Once you know what the "hit" was you can proceed and trying to get and updated NBI, once you have presented you court papers.

UPDATE: NBI did release my clearance with a "No Derogatory Record" remark. You just need to show your court papers before they release it that is all. Don't come in the bureau empty handed. :) My paranoia was not needed. LOL

I'm curious how a minor at 16 ended up with a criminal case? Unless charged as an adult?

In my case, it was originally filed at DSWD as I was a minor at that time. But, was already turning 16 in a month or two. We did a test at DSWD and its results were that "I was already capable of thinking correctly and able to differentiate between right and wrong." The plaintiff just wanted to make it harder on all of us so they decided to take it to another level and refused mediation. Hence a court case filed at RTC complete with attorneys and all. Case was dismissed when we did a public apology to the plaintiff printed on a local newspaper. In short, pinahirapan lang kami nung nag-kaso.

A hit means that you have a namesake who has already applied for an NBI Clearance. They would need to perform further verification thats why it takes longer.
