so yeah i got an RFE on my I-864

And it has two items checked

it says :

[x] The listed income tax documents/IRS statements for the year 2005 are missing/incomplete

(I'm pretty sure.. according to an operator i spoke with on the phone the other day that.. My 2005 w2 was not sufficiant enough and they need a tax transcript)

(now the second one is what im confused about.. because I submitted tax years 05,04, and 03. and

{x] You have not enclosed an explanation of why you were not required to file income taxes under Federal tax laws for any/all of the 3 most recent tax years..

so if i submit a tax transcript of 2005.. does that cancel out the second thing?

also.. with my checklist i got a copy of the 230 for my husband

now do i submit the missing info with the checklist in the same envelope as the 230?

****edited**** oh i just saw on the barcoad sheet it said putting multiple case info in the same envelope may delay the processing of your cases'

so seperate envelope for the 230?

10th May 2005 I130 packet sent to TEXAS forwarded to Cali.

12th May 2005 NOA1 Received date.

14th May 2005 delivered at 4:34 am LAGUNA NIGUEL, CA 92607.

23rd May 2005 NOA1 notice date.

27th May 2005 NOA1 hits the mailbox.

13th August 2005 po po form mailed off with £10 cheque.

2nd September 2005 po po letter arrives.

3rd September a 4 week visit with hubby in GA

30th september 130 days on I130 and counting.

January 2006 case arrives at NVC finally(not sure about exact date)

17th February 2006 IV bill mailed back

sent I-864 02/23/06*

Visa Fee Bill recieved 02/27/06

03/07/06- called nvc.. they recieved visa fee bill and are sending out documents!!

03/07/06- called nvc and was notified RFE was being sent out.. :( !

03/07/06- requested 2005 tax transcripts (7-10 BUISNESSDAYS FOR ARRIVAL)

oh.. the wait.. is driving me mad...

03/11/-6 Recieved and RFE on I-864

03/14/06 - Recieved 230 (waiting on hubby's 230 in mail)

03/15/06- POSTED RFE PRIORITY MAIL

17th February 2006 IV bill mailed back

21st April case complete (sorry i have missed some dates of forms going back and forth)

2nd May case forwarded to Embassy in London

10th July 2006 visa interview 10.30 a.m.

HUBBY WAS APPROVED!!!!!!!! ♥ .. waiting on visa in hand.. omg omg omg omg omggggggggggg!!

Wow, seems kind of strange they are giving you a hard time about 2005 tax documents. Many of us have yet to file 2005 tax returns. Sorry to hear about your trouble.

On reading what you posted.......if you submit the 2005 tax returns/transcripts then it would cancel out the second. Didn't I read in another of your posts that you supplied 02, 03, 04 and then the W2's only for 05? I may be wrong but by submitting the W2's for 2005 they in turn now want to see the transcripts and that you have filed. In hindsight it may of been best to withhold the W2's for 2005 until interview, but who really knows......they may have requested it anyway.

Im unsure on your last question but its always a good plan to do whatever you are instructed to do ;)

Considering that the latest is what they go on....not really :lol::P If you had done that with the prior years and not 2005 it may have been a different story.

Send it off and you will be through this stage in no time :thumbs:

Ok so I have a question after April 15 are you allowed to only submit the the current years taxes? Since they changed it and you only have to submit more if you want to?

Thats an interesting question Jennieh and one I have been wondering about the past weeks. I think we are going to have to wait and see what the NVC requests when they send out the I-864. The memorandum re USCIS policy on the I-864 states that forms signed after April 15 2005 will be subject to the new 1 year rule for tax returns....will be interesting to see when it is going to apply for those doing CR-1
