Hi Everyone,

Can anyone recommend a good lawyer in Southern California? I will apply for the I-130 in April 2007, but the new rule (under #7 , proof of ongoing relationship) has made me nervous on how to apply.. I posted many times on this forum, but no one seems to have an answer.. my original question was this...

"Sorry, I know I asked this before.. I was just wondering anyone's comments on the I-130 preparation.. do I submit everything in a small yellow folder (I-130, G-325A, and passport photos and marriage certificate).. or submit everything in a big package because of the new I-130 #7 rules? (proof of ongoing relationship) I am planning on submitting an I-130 soon (April 2007).. please help.."

Yes, but with the new rule (#7 of the I-130), now you have to prove that you have an "ongoing" relationship.. so meaning we now have to send a big package (with cards, emails, phone records, wedding photos, and other things).. don't we?? :blink: or can we just submit the I-130 like before? Originally, you just needed to send the I-130, G-325A, passport photos + marriage/divorce certificates.. now you have to send the other stuff, am I right??

I have completed the I-130 and G-325A (my 4 copies) so far.. I will get her G-325A ( 4 copies) and passport photos when I go back.. I have made a blue binder now consisting of cover letter, table of contents, and the necessary information all laid out.. Title page for each section =) Hopefully I will be prepared enough... but I am just worried about this new rule..

This is just my opinion as I completed my K3 last year.

If you believe you require the extra items, send it in a seperate section (probably at the back of the packet) and label it something like, "evidence of ongoing relationship". Make sure you have copies of everything (probably send copies) in case it gets 'mislaid'.

This way, if they do require this stuff, it'll be easy for them to find and included in the package, but if they don't, they can just put it out the way and all the stuff they do need will be ready for them and they won't get bogged down with things they don't need.

I think that's what I would do if I couldn't get a satisfactory answer, rather than paying to ask a lawyer.

However, as I said, it's not a guarentee, just an opinion :)

Thanks for letting me know :thumbs: Seems like this is still new to everyone who apply for the I-130... just like you, we plan on getting married in March 2007.. so that doesn't leave much validity for the letters regarding my friends that know about my marriage.. so that's why I want to submit the other stuff I mentioned (marriage photos / videos and with at least 3 different background settings of other photos/people, phone records, emails, package slips, airline tickets and such..)

We plan to create a joint account in March 2007.. hopefully there will be at least 6 months before they actually start looking at my application, so that should help with the I-130 proof.. Also, I have phone records from my home to her home, and also from Skype (November 2005 - January 2007) so far.. plus pictures and other things.. so hopefully this will be enough..

Most will tell you that if you've got a simple petition for a K-1, K-3, or CR-1/IR-1 you don't need a lawyer. A lawyer can't make the process go faster and depending on how quickly they respond to the USCIS it will often only delay the process.

Edit: I should add that there are other (and IMO better & cheaper) options to immigration lawyers as well. I have someone assisting us with the process. Feel free to PM me and I'll give you his info.

We just finished our process and the proof of ongoing relationship is for the interview portion of the process. You will need this proof during the interview with the consular you do not need to submit it with your application package.

Gogo, I am pondering this too. I am filling out my I-130 right now and we have only been married for a week. In my opinion, to provide proof of an ongoing marriage is complete rubish since our marriage has JUST started. The way it reads is that you should provide it, it does not say that you require it. We may have her parents write an Affidavit supporting that our marriage is legitimate. The easy alternative could be to submit the old form since the are accepting it.

Thanks for responding to my other posts!! I'm not sure about that.. the government can get all picky.. they can just use any excuse to make a RFE (even if it is their fault, if they have too many applications to do this year, for example).. maybe I'm just making of them.. but I'm just not sure.. yes.. people said just to submit a few of the required items.. My thoughts are (they could be wrong) that if I submit "double" of what they require .. then they can't say anything bad.. because it is more than what other people have submitted.. If they want to take it to court, that's fine.. even better for me to win =)... but hopefully it doesn't come to that..
