Completely Clueless About how to change single to married

We just sent in our AOS papework last February, however, we might get a request of asking for my husband's latest Tax Returns since I will be interviewed after April.. is that right?

Since we might be requested for the updated Tax Returns, he does need to change his single status to married. From what I have been reading, the easiest way is to change it to Married Filing Separately...

What are the steps? I appreciate the help!

When did you get married? If last year then should have or still can(over two weeks left till the April 15th deadline) file as married. If this year then no need to worry about it until filing next year.

The U.S. Is a self reporting tax system.

If your husband was married on Dec. 32, 2014, then he must file as married. It doesn't matter what is on his W-2 since his marital status is self reported to his employer.

He can file jointly with you if you have an ITIN or SSN.

We were married last October 2014 sir.. Do I need to send him something from my side to report it? We got married in the US while I was visiting and returned home after that.

Thank you sir, he is a self independent contractor, I am not quite sure how we go about to do the changes if we want to file separately.. Are there additional forms to fill up?

I do not have any ssn or itin and was hoping to just go the MFS route?

I would recommend you get a SSN, Then use the MFJ status, as you would be an exemption and your husband would pay less in taxes.

I will have my SSN number sir once I enter the US, hopefully next year we would be MFJ..

but for now sir, my concern it might take a while and would not make it for our interview? I heard that it might be a red flag if they would still see the latest ITR as single?

So he does his 2014 tax return as MFS, lists you as wife and writes NRA(Non Resident Alien) for your SSN. And you do nothing. If he has already filed his return as Single, then he needs to file a 1040X amended return as MFS. Should not be any red flags either way.

Just to add if your husband files married separate this year. Then once you are in the states he can ammend this year tax return to married jointly usually there are bigger tax breaks filing jointly

no I did not do dcf. I sent both my Aos and IV packets in before I paid the IV fee and fill out the DS-20 form. The NVC state that it takes 60 days to review documents. Right now It is taking a lot less time for them review documents, for a lot of people. It only took them 38 days to review my documents. while I was waiting for them to do that. I was able to pay my IV fee and fill out the DS-260 form

Have you done everything you need to do at nvc? If so your case might be complete. Here is a link to a spreadsheet someone one made with the scan date(when NVC receives your documents) to cc. Right now it looks like people with scan date up to Feb 23 are getting cc

If you do not want to call NVC everyday there is a way to know if your case is complete log onto the ceac website, if you see three NA ( the AOS fees will change from paid to NA) you most likely have case complete

Oh wow! Happy for everyone who got a cc my scan date for the AOS and IV package is 02/25.. Hopefully I'll hear good news soon and no checklist.. I'm scared of that

I checked my status I still have no 3 n/a's, I shall wait for that one then.. Or should I call since maybe I might have a checklist?
