I-864 - I keep getting one box wrong

Hello

Can someone help please?

For form I-864 at 13.a.1 it asks for total income for 2013 (I submitted the form in October 2014 initially.).

First, I put zero as all my income was from Australia. I thought it would be zero as my income was not USA based. I received a checklist and I was told it was wrong and needed to match my 2013 tax return.

I then reviewed my tax return, line 22, and changed it to be $2,965 or something.

Well, we now have a case complete, yet they said I still filled in the box wrong. I need to correct it and send the corrected signed form by post to my husband in Australia (I am in Georgia, USA) so he can take the correct form to his interview on April 21.

What number do I put here??? I have sent in my tax returns and I am confused. I have done it wrong twice and NVC haven't helped to say where I find this figure. Maybe I am just a noodle head. If so, I apologize.

Can anyone clear this up for me so I don't get it wrong a third time? I thought of sending a form to my husband that I have signed with that box blank so they can complete it at the interview? Will that work or not? I can send in a possibly correct form and a form with the blank box in case I get it wrong a third time so they can fix it at the interview if they will allow that.

I would go with him to the interview and do it that way but I am now on the other side of the world.

Thanks in advance and I appreciate your help.

You need to explain the background more clearly...even I can't understand with 100% certainty...

You can't send a blank field form and have someone write in the number...because at the time

when you signed...you are declaring that everything on the form is complete and accurate,

and any modification by someone else after your signature would void that document.

1) You lived and worked in Australia during all of 2013, and there is no income from US?

2) You filed tax in US and/or Australia for 2013?

3) What was your gross income for 2013 was $2,965 (and that's what's on Form 1040 line 22?)

4) Which tax record did you sent? Just one from 2013 that is filed to US IRS?

5) Did you run a tax transcript from IRS web site to see if your gross income really is the

number that you are putting down on I-864 form?

6) Did you file tax (and in which country) for 2011, 2012, and 2014?

7) Did you fill in 13.b.1, and 13.c.1? You need to provide last 3 years of tax records.

8) At this point, if you already filed tax for 2014, then you need to provide tax records for 2012, 2013, and 2014.

9) Can you post exact text of what they were asking to correct?

You can't send a blank field form and have someone write in the number...because at the time

when you signed...you are declaring that everything on the form is complete and accurate,

and any modification by someone else after your signature would void that document.

1) You lived and worked in Australia during all of 2013, and there is no income from US?

Correct. I have lived and worked only in australia since 2005.

I have moved back to usa february 2015, so that doesn't affect the form.

2) You filed tax in US and/or Australia for 2013?

Yes. I have to file in australia and pay taxes, and I have always filed in the US to report my foreign income.

3) What was your gross income for 2013 was $2,965 (and that's what's on Form 1040 line 22?)

This is what was on line 22, after the foreign income exclusion. I have tried using this number and just received a checklist today saying its wrong, again.

4) Which tax record did you sent? Just one from 2013 that is filed to US IRS?

I sent my united states tax returns for 2011, 2012, 2013. All have foreign income, which is reduced after the foreign income exclusion, and further reduced by deductions, to zero so no taxes owed. They were prepared by a united states CPA.

5) Did you run a tax transcript from IRS web site to see if your gross income really is the

number that you are putting down on I-864 form?

I have tried multiple times to get a tax transcript. I have entered in my details on line and it will not accept my information. I called the IRS two days ago, was on the phone for over two n half hours and transferred four times. I gave up.

I have all my tax returns. Surely the number is on there somewhere.

6) Did you file tax (and in which country) for 2011, 2012, and 2014?

2014 I am completing for US now. Australia has a different tax year. I am up to date on all my taxes in both countries.

7) Did you fill in 13.b.1, and 13.c.1? You need to provide last 3 years of tax records.

Yes both boxes have been filled in with the number from line 22 from the corrosponding tax return. No checklist item for either of thesr. As stated above, although it states optional on the form, I provided the tax returns.

8) At this point, if you already filed tax for 2014, then you need to provide tax records for 2012, 2013, and 2014.

They said to not file a new I-864 as this will delay the interview which is in four weeks. I am sending the tax transcripts for the joint sponsor for 2014, and a copy of my tax return as lodged with the IRS for 2014.

9) Can you post exact text of what they were asking to correct?

I will try post a photo of it

Here is what is on the checklist.

I'm getting annoyed as I sent a letter the first time explaining the situation.

I then sent a letter in response to the first checklist, again explaining the situation. I also sent payslips from my job in australia and my employment contract and my 2013 tax return again. I stated no w2 as I had not worked in USA.

Now they have asked again.

Obviously they are seeing some discrepancy somewhere...

They are asking for your 2013 W2 and/or IRS tax transcript also.

If you are having trouble with the online tax transcript, then try

going into a local IRS office and get it there.

Perhaps your foreign income exclusion is causing confusion...

but first get the tax transcript to see if numbers aren't matching to what you filed.

I've just called the IRS to have a transcript posted to me. We will see how this goes.

I still think I should be able to find the number on the tax return. This is ridiculous. The number does not affect the application in any way, shape or form. Why do they keep asking for it. It will not help my husbvand get his visa, and it will not deny his visa. The income was from Australia when I worked as an accountant an is NO LONGER continuing as I told them. Can they not just look at the tax return and let it go.

On the phone with NVC now. Between NVC and IRS I spend hours a week on the phone for ten minutes to speak to someone. Not what I want to be stressing about at 4 months pregnant. I just want this over with.

I have looked at my return. line 7 has 'wages', line 22 states 'total income', line 37 says 'adjusted gross income' - this matches line 22? Line 38 matches Line 22 and 37, and line 43 says 'taxable income' and is zero.

I have put zero on the first form. This is on line 22, 43.

I put $2,795 on the second form. This is line 22, 37, 38. The form is a 1040. I don't see how I keep getting it wrong. The only other amounts are a -$40,000 something for foreign income exclusion and a $3,000 amount for a deduction...

I have just called NVC

They confirmed it is line 22.

they said I need to submit an original form for my husband to take to the embassy and that's why I have a checklist. does that make any sense at all? why do they need a signed form and now he needs a signed form??? what was the point in submitting an original signed form.
