Hello everyone! I would like to ask for your opinions on this matter. Tomorrow is the 1 year anniversary of our aos application. I received a mail saying that our file was transferred to a field office in Reno last week. Believe it or not, we are actually thinking of flying there and get an info pass just to get an update on my case. We are getting desperate bec few months ago, we booked tickets going out of the country thinking that this process wouldn't take this long. Has anyone tried visiting the field office where their case is at?

Yeah it has been a little spooky this week, very quite. I'm hoping it is because they are moving the cases around and I know one day this week the system down, Monday I think.

I would like to hear something soon, maybe today!! Good Friday should be GOOD right?

Didnt know their systems were down, but I don't check my status any more.

No no one has, but Guiseppe did an info pass this week and was told if the file had been at that office they would have gone through it there and then, so I guess they will if your file is in the office you go too, dependent on how nice the IO is!

Also, I hate the fancy, new-ish case status site. Never in our lives have we so deeply loathed the phrase, "My Fingerprint Fee Was Received". My head explodes every time.

What are we lovely people in waiting using to predict? I'm way behind, I know.

We predict with our gut feeling, see who is the most psychic. Nlhernan is the winner up to now, one day out of his predicted date!

Good morning everyone! Just woke up. Good Friday, I hope it lives up to its name. There are some of you over the year mark, and I pray that you receive that approval very soon. I am currently in Mexico with my wife and her family. We can only hope we don't have a hard time re-entering the United States. Lets fill up this forum with positive vibes and see if that will help us get those approvals!

Hopefully there will be approvals, but you need to enjoy your time in Mexico and forget the USCIS for a while, we all deserve a break from USCIS!! Happy Easter!! :)

i am interview waiver ,well on march 2nd i had interview , after waiting an hour she said they dont have my file , so we came home .in the mail there was letter saying my file in transit to Santa ana CA . i am in SC , so yesterday 2nd april i recieved letter for another interview date 4 May . 13 months of waithing , still waithing most anoining processing system

This snafu, first the failed interview and the second scheduled interview while your file is in Santa Ana means you need higher level inquiry. You need to call USCIS, get to Tier 2 and then you tell them you need to talk with people who can really do something...That is TIER 3. Yes Virginia there is a TIER 3 and this is exactly what they are for. If your file is in Santa Ana, you will not be interviewed and this second interview is just as bogus as the one before. This is not the first occastion that this has occured. No one, I'll say it again, NO ONE on this thread has been successfully interviewd after NPIW letter. Someone else had the same experience 2 months ago.

Call you representive's office, better yet go to your representatives office and explain to them that USCIS is yanking your cahin and scheduling bogus intervies and causing great anguish. This inhumane behavior must stop...

Fire off an inquiry to the ombusman today and document everything. Send copies of both interview letters and tell them exactly how you feel. This is 50 miles over the line...

This is when a good immigration attorney would be useful...Notice I said good...

Hi all. We filed on the 22nd of July 2014, but didn't receive the NPIW letter until the first week of January. Yes, I realize we're together and this should make everything better, but living in limbo frustrating nonetheless. I suppose we're paying the price for getting a K-1 approval in 33 days. . .

Question:

If he doesn't receive his GC until after we've been married a year, does this change anything regarding ROC?

You need to know this. The date of your NPIW letter means nothing. It is your NOA. That is what is important. It is simply important that you got a letter, not when. If you see people with later NPIW letters get approved, you will be frustrated but if you check there NAO it will likely (not always) be before yours...

It needs to be 2 years married. When the IO called us on the day of approval she specifically verified our marriage date and because it was less than 2 years she said we would get a 2 year card...Though there is a rub in a letter we got 2 days ago which I will explain soon.

Looking forward to the explanation!! Isn't the person who mentioned Santa Ana the same person who turned up for the interview and found their file was on the opposite side of the USA?

Great my account has been locked for inactivity/wrong password BS.

Mine did the same thing this morning. I changed the password and was able to get in after that with no problem.

You know I've had my GC for 2 weeks now, and I feel no different than I did before I got it and I was in the same position as everyone here and I've realized it's because I know (and we all know) that ROC is gonna be another ordeal in 2 years time, they tell you to make sure you document the 2 years so you have everything for ROC, so for the next 2 years we're all gonna be living life knowing ROC is coming and that we need to save everything, document everything and overall worry about ROC and hope that it's not gonna be a pain like every other process was with USCIS..

Wow you're talking American, ie gonna realize!

I am not even thinking of ROC and gathering evidence, we do have a joint bank account, however its not the one my husband banks his wage in, we do have joint health insurance, I don't pay any of the bills yet, not until I get a job, nor do I drive yet, so no joint car insurance. I am what is called a housewife right now. So its hard to show joint anything, but hey ho, I am sure it will change sooner rather than later.

I couldn't have asked for a better segue to what happened during our conversation with the pleasant Immigration Officer from the Imperial CA FSO last Friday. As I said she called to get us to send a copy of our marriage certificate, which they lost (because my lawyer sent it, I have a copy of the package he filed for us), so that she could process approval. That was only a small part of the call. She talked about 2 other things. First she made calculation of our length of marriage because she reiterated what we now know that if you have been married 2 years at the time of adjudication, you get a 10 year card. We were not.

But then she talked for almost 5 minutes about ROC. Remember you never look a gift horse IN the mouth when you get information FROM the horses mouth. If that's not mixing my metophors, what is...But I digress. She said that 90 days before the expiration of the conditional green we must file an I-751 Application for Removal of Conditions. No sooner. She was emphatic that we must include evidence of marriage - entangled relationship so to speak. This includes but is not limited to bank statements, utility bills, credit card bills, etc. And not just one statement. She said 24 months of each and every account. Also include joint titles of cars, houses, vacation properties, yachts, Gulf Stream jets, etc...She repeated three times that we needed to send all 24 months of everything. I figure that if she was someone who adjudicates these as well she knows whereof she speaks...Again straight from the horses mouth, a nice horse at that...

But then we got a signed note from her regarding ROC 2 days ago and now I'm a touch confused...It says this:

APPLICANT'S COPY

REMOVAL OF CONDITIONAL STATUS

Pursuant to Section 216 of the Immigration and Nationality Act, you have been granted Condtional Permanent Resident Status as of 3/27/2015. You must file Form I-751, Petition to Remove the Conditions on Residence, between 12/27/2015 and 3/26/16 (i.e. the ninty (90) day period just prior to the second anniversary of you becoming a Conditional Permanent Resident. [sic] If a petition, Form I-751, to remove conditional basis for your status is not filed within this period, your Conditional Permanent Resident status will automatially terminate and you will be subject to deportation from the United States.

It is just very interesting. Natonstan, did you get one of these, or are we just another "interesting cases" (something you do not wnat to be when a doctor mentions that to you when you are the "interesting case")?

I didn't get anything like that mentioning ROC? That sounds BIZARRE, did that come with your Green Card or was that a separate notice altogether? If it came with your green card then I'm gonna have a loot at my notice to double check, all I know is that my Green card has an expiry date of 16/03/2017

If it came with your green card then I'm gonna have a loot at my notice to double check, all I know is that my Green card has an expiry date of 16/03/2017

No this came out of the blue in separate cover from the Imperial FSO with handwritten info (our "signatures" and hers). It is simply bizzare and the dates are type written not hand written. It looks like the papercut lower half of a full size page...Don't know what to make of it...

That would confuse the hell out of me that's for sure, I'd be looking into that because it definitely sounds odd

Bizarre, perhaps they have changed the rules because of the vast delays?

But surely I would've got one too? And we've not heard anyone else mention anything like this, I think it's a classic case of USCIS not knowing their own rules as always!

That would confuse the hell out of me that's for sure, I'd be looking into that because it definitely sounds odd

But surely I would've got one too? And we've not heard anyone else mention anything like this, I think it's a classic case of USCIS not knowing their own rules as always!

I would say that too, but unlike Tier 1 or 2 or SR replys, this came from a IO who makes the decisions...Who knows...Haven't yet determined what directions we will go in. Remember, it's always easier to beg for forgiveness than it is to ask for permission...

Oh and BTW, the envelope was handwritten as well...

I couldn't have asked for a better segue to what happened during our conversation with the pleasant Immigration Officer from the Imperial CA FSO last Friday. As I said she called to get us to send a copy of our marriage certificate, which they lost (because my lawyer sent it, I have a copy of the package he filed for us), so that she could process approval. That was only a small part of the call. She talked about 2 other things. First she made calculation of our length of marriage because she reiterated what we now know that if you have been married 2 years at the time of adjudication, you get a 10 year card. We were not.

But then she talked for almost 5 minutes about ROC. Remember you never look a gift horse IN the mouth when you get information FROM the horses mouth. If that's not mixing my metophors, what is...But I digress. She said that 90 days before the expiration of the conditional green we must file an I-751 Application for Removal of Conditions. No sooner. She was emphatic that we must include evidence of marriage - entangled relationship so to speak. This includes but is not limited to bank statements, utility bills, credit card bills, etc. And not just one statement. She said 24 months of each and every account. Also include joint titles of cars, houses, vacation properties, yachts, Gulf Stream jets, etc...She repeated three times that we needed to send all 24 months of everything. I figure that if she was someone who adjudicates these as well she knows whereof she speaks...Again straight from the horses mouth, a nice horse at that...

But then we got a signed note from her regarding ROC 2 days ago and now I'm a touch confused...It says this:

APPLICANT'S COPY

REMOVAL OF CONDITIONAL STATUS

Pursuant to Section 216 of the Immigration and Nationality Act, you have been granted Condtional Permanent Resident Status as of 3/27/2015. You must file Form I-751, Petition to Remove the Conditions on Residence, between 12/27/2015 and 3/26/16 (i.e. the ninty (90) day period just prior to the second anniversary of you becoming a Conditional Permanent Resident. [sic] If a petition, Form I-751, to remove conditional basis for your status is not filed within this period, your Conditional Permanent Resident status will automatially terminate and you will be subject to deportation from the United States.

You can obtain Form I-751 on line at www.uscis.gov

  • Ensure you complete the form accurately and provide documentation that proves you have lived together for the past two years and are financially committed. For example, joint utility bills, rental agreements, bank statement, income tax returns

If you notice that dates don't jive. 12/2715 is only one year. Not sure I want to send a FAX to her to elaborate or simply apply early and attach this notice...I'm gonna talk to my lawyer. It is just very interesting. Natonstan, did you get one of these, or are we just another "interesting cases" (something you do not wnat to be when a doctor mentions that to you when you are the "interesting case")?

I would assume this is a typo by her on those dates. But to make sure, I'd look at the expiration of the actual green card when it arrives. But still, perhaps you SHOULD file when it tells you to. As you say, it's better to ask for forgiveness than permission (<--- the teacher's motto!). ;)

06/19/2018 - ROC still pending with no news but that wonky glitch back in February, so we went ahead and filed for citizenship
