Thank you so much USCIS, I just got a warning letter from DMV requesting me to bring evidence that I am still legal resident in USA. Where is the hell our Green Cards? It is almost one year now. Now I have to file for renewal of my working permit and take the Stupid Waiver letter to DMV and hopefully they will believe that it is USCIS mistake and hopefully DMV will renew my driver's license. Or they will let us ride taxi just waiting for the Black Card???. I did not expect to find such service in such (Advanced) country as they claim. I am done with this GC stuff. This is so frustrating and unacceptable at all.

Hi all. Long time listener, first time caller. Checking in on this thread, hearing that other people are in the same situation as me, has been a constant source of reassurance throughout this process. So here's my ongoing Adjustment of Status story.

NOA1: April 28, 2014.

NPIW: July 29, 2014.

Last week, April 29, a year and a day after USCIS started processing my case, I got a case update text. I logged in with baited breath. It was an RFE.

After a long week of waiting (during which the letter was sent to my old address and rerouted by USPS, despite having updated the address with USCIS when we moved in July - doesn't bode well for the greencard...) the letter finally arrived today. Now, I suspected it might be down to an out of date medical exam, or something to do with my chickenpox vaccine (I got one shot before filing the AoS application, and then the civil surgeon told me she could just sign off on it and we could submit, rather than waiting a month to have the second booster shot). But in fact, the evidence they requested is 1) documents to establish a bona fide marriage and 2) copies of State license or ID cards for me and the wife. It's almost more annoying that they asked for these, rather than the medical stuff. Seems totally unncessary. Obviously I submitted copies of passport biometrics page etc with the application, and never once did I see a State ID listed as a requirement (correct me if I'm wrong).

In any case, I ran over to the DMV (which contrary to sitcom cliches - or compared with my USCIS dealings, at least - was an absolute pleasure) and signed up for a non-driver's ID. Apparently the card can take 2-4 weeks to arrive, but I got handed an 'interim' card, which has all the info the real card will have, sans my picture. Hopefully USCIS will accept the interim card for the RFE.

Horrifyingly, the RFE letter says that after submitting the required evidence, "you may inquire about your case no sooner than 180 days after the date of this notice." But I get the sense that approvals tend to come pretty quickly after sending in the requested evidence?

Incidentally, before we started the process of getting me into the US, we tried getting my partner a fiancee visa to live with me in the UK. For reasons which boil down to us failing to read small print about convoluted financial requirements buried in obscure pdfs, she was denied the visa. The British government doesn't do RFEs, they just do a straight yes or no. And when it's a no, there are no refunds (it was around £1300, from memory). So while Adjustment of Status has been a long and frustrating process, I'm glad that USCIS at least asks for evidence, rather than flat out denying visas/greencards for trivial, arbitrary, idiotic reasons. (I'm sure that happens occasionally, but the UK government seems to do so as a matter of official policy).

HI Rob,

Thanks for sharing. I am 24 april 2014 noa1 and still no update but I am sure they will send me a RFE (they can create their own rules, they will find ^^) but usually, when I see someone receiving a RFE after one year, they have their card on production some days later. Don't hesite to come back to let us know the end of your long journey :P

Well its a week after my Interview in Atlanta :) still no news on my GC but I did get a text today saying my EAD and AP renewal has been approved, now we wait for that to arrive as the old one is up on the 22nd of this month. Now they have approved that I'm not really in to much of a rush for the GC its only been 14 1/2 months so another couple wont hurt as it should be a 10year when it arrives ;)

what really annoys me is I sent in a marriage certificate with my original green card application and now I have to go through the hassle of applying for a new one! what happened to the one I sent them last year!!

Seems like a common problem, happened to us as well. You'd think, hmmm, k-1 visa class, fiance visa, gotta get married. We all sent it but some jerk at NBC must have culled them out in the initial screen...idiots, that's all I'm gonna say...

True, but they are extremely limited. My husband went and got his license, based on his EAD, and right after that, California made it legal for nonresident aliens to get a drivers' license. I went back to the DMV (not a bad experience where I live either) to see about changing his over, since the expiration date would be much different, and the woman working there said that the licenses are so restrictive, that even with a year-long validity, it's still better for him to have that one. *sigh*

Also, saw this reply in my August AOS group:

Still waiting! Just wanted to check in with everyone. I filed a request with my Senator and also reached out to my HR department who sent some files to our company's lawyers to see what they think...just wanted to share the reply:

"Thank you for providing the materials relating to RelativeWays. I see that she entered the U.S. using a K-1 fiancée visa.

Please note that the K-1 program is unfortunately a very low priority of the U.S. government. In my 30 years’ experience in this field, I have rarely seen the government keep to its stated processing times in the K-1 area. Typically the process takes far longer than estimated.

Unfortunately, there is nothing we can do. Given that RelativeWays has a “combo card,” she has the ability to travel internationally and to work in the U.S. So she really has no recourse here. If the USCIS had failed to grant these benefits, she would have the ability to insist on the adjudication of the EAD card and the Advance Parole travel permission (which is what she has in the “combo card”). But if RelativeWays is merely looking to accelerate the issuance of her green card, I’m afraid she has no recourse but to wait."

I am confused. Are there different types of Driver's license?

You know the one that went into effect at the tail end of last year, here in Ca? It's for undocumented people, and they have a longer exp date than someone using their EAD for proof of legal residency. It's also very restricted. one example: it's ONLY valid here in CA, whereas a normal license is valid in all 50 states, and some other countries. I know a lot of people near me are undocumented, and there was much talk about it being a ploy to get their names, locations, and status so ICE could kick them out of the US. :(

Yeah I have heard of some getting a license and it expires with the EAD and some have gotten one that is good for four years. My husband received the one that doesn't expire for 4 years.

I did hear the undocumented people were now able to get a license, but I didnt know all of the details about it. When we went to the DMV, my husband took the written and the driving and we used his EAD at proof of legal status and he received a license that is good for 4 years.
