This is very interesting!! I didn't know it gets reviewed within 45 days, I don't remember seeing an email/letter on here regarding the length of time, but nevertheless is is very interesting and gives us information we can pass on to newbies. Thanks for sharing!

Good afternoon Peeps,

Just been going through all the posts and trying to reply to each one, sorry if I missed any one out. Derwood glad you are going to the OMBUDSMAN, it's your only avenue left, it can take up to 45 days apparently but if youve done it today then the clock will start to tick and each day you will be closer to that elusive GC.

Sat here and wondering if there will be more approvals today, we saw them last weekend which was great.

Well after going for a few drinks early for my Birthday ( thursday next week but on call with work so cant do it then) I come home to a letter from USCIS telling me I need to have an interview, They have hade my paperwork since 18th March 2014, so almost 13 months after they are saying I need an interview ??? I got my NOPIW in june last year lol anybody else had this happen ??

I gotta tell you, I'm very wary of these "...we'er going to interview you..." but not give a date. GusippiG got 2 0f them fron the NYC office but then found that their file was still in NBC and it ultimately went to Florida for adjudication (pending). There will be no interview. If they want an interview, they schedule one. The only poster here with a NPIW letter who had a scheduled interview went to it to find her file was not there, but at another office. Everyone who has a scheduled interview should confirm that interview with Tier 2 or the local FO.

I don't know what to say but to call Tier 2 and ask them where your file is and follow up with a Congressional inquiry. I would visit the congressman's office in person...

First, Congrats to all who got approved! :dancing:

Second, last march 3, i sent an SR and their reply was my husbands case is still at NBC... so after a month, April 3rd, i sent another SR and their reply was waiting my inquiry to be assigned to a representative and no further updates after that...

So, today we checked our mail, and we received an RFE letter dated April 3rd! I am so disappointed and all! and now my husbands medical and vaccination is expired, well of course since we've been waiting for so long, few more days and it's a year since we submitted the I-485.. that's not out fault! And plus, i have a copy of what i sent to them and i did send all those.. Aarrgh! Am so upset! :angry:

Anyway, here's a copy of our letter!

Does my husband have to do the whole medical again?? or just the vaccination record??

What other evidence can we provide?? Pls. Help!

An RFE at this point means you have been provisionally approved awaiting your response. You also know where your file resides. It stinks that you have to spend more money to fix this but you also know that upon receipt, you will be approved...

Yes its on May 1st in Atlanta, so looks like another day off work. My online update still says On March 18, 2014, we accepted the fingerprint fee for your Form I-485, Application

Like I said, confirm this date with Tier 2 and/or the Atlanta FO before you go...We've seen problems...

It sucks that after a screening by NBC prior to your NPIW letter found no red flags to interview you immediately that they would now do it...Sorry...

I would print out the document that shows in the website and if they still deny then ask to speak to Supervisor or Manager. Since the RFE mentions about driver license and I am not sure whether they asked for it or a suggestion. Also, instead of submitting DL, he can submit a state ID which he can get more quicker. I got my state ID in the same day in Florida and of course, it will be different between states. If he cant get ID and no DL, then I would recommend to write a letter to explain why he did not have either DL and state ID.

To be honest, I have no idea how to deal with photos. I have submitted photocopy in my I-129F instead of original.

I would choose few pictures in different events and no more than 15. I guess you can submit the original if you have saved those pictures in memory card for your record.

Again, you need to gather most documents that have both names on as possible as I stated early ( joint tax, bank account, lease/mortgage agreement, pictures, etc.). Most of NPIWs were not asked to prove the marriage. It might be random.

I would send in anything you can think of that has both of your names listed: lease/rental agreement, car insurance, bills, things like that.

As for the medical, it looks like you need the full work up as we had to do. Call around to civil surgeons near you to find the best price. They typically only accept cash. Get a receipt! Ours cost $200.

With the pictures, I would just print them on regular paper and add captions with dates, places and people listed.

But what I'm not understanding is this "last request: two cases, two sets of documents". Is there a K2 in your case? With the way that reads, you need to send in 2copies of everything. I'm baffled.

If it were us, we'd have a civil surgeon do just what is asked for: the I-693. Of course, their punctuation is horrible; who knows what they're actually asking for! I noticed NOTHING is checked as to the reason for this request. Odd. I have, however, read of those who had to do a G-325 while at the interview. We sent one in for both of us with his petition.

An rfe when you filed over a year ago, they have to be joking!! Disgraceful! Are they going to pay for it? I would personally be making a complaint if they did it to me as it their fault and you have to pay for their mistakes. The ombudsman isn't just there for enquiring at the progress of an application it is also there for complaints! I should imagine regarding the medical it would just be the vaccination record. I don't know whether or not your injections are current or one is due. I would ring up the USCIS and ask before paying for a whole medical again!

What makes it worse is the check list they give you, It looks like everything that was needed for the K1, no idea how I'm ment to get a police report in 3 weeks from the uk

It sounds like they lost your file and they're making you pay the ultimate price for their incompetence...

Generally the consulate can turn around such a request in a couple of weeks if you explain the problem...

Hang on a minute, what checklist? Have I missed a post? Can you blank out the personal details, photograph this checklist and upload it to the thread please?

Also, isn't it you that have your second wedding anniversary coming up in June? If so you need to re-arrange this interview to after that date. You can do that online I think. Tell them there's insufficient time to get the documents together. Tell them anything. Tell them you cant get time off work without 60 days notice.

Would you have time to update your signature too please. It helps a lot to be able to see the dates at a glance.

Well, 14 days after approval and they ordered a card produced, today they massaged that a card is being produced. Guess we can say they're not using our application fees to buy ink or quality printers...

I know they have plenty of GC's. Even though they indirectly denied it to Congress, they recently ordered a number of million GC's to cover future DACA applicants...

What makes it worse is the check list they give you, It looks like everything that was needed for the K1, no idea how I'm ment to get a police report in 3 weeks from the uk

Maybe this is not as bad as you think... I read the checklist that you posted, and it is only asking for police reports related to any arrests. So, I imagine that if you provided a police certificate showing a clean record during your K-1 interview then this requirement would not apply. I'd call and verify nonetheless. I'm interested to know the outcome.

The except below is from the checklist you provided:

"If you have been arrested, bring the related Police Report and the original or certified Final Court Disposition for each arrest, even if the charges have been dismissed or expunged. If no court record is available, bring a letter from the court with jurisdiction indicating this."

I would agree with this completely. In fact, I'm pretty sure we'll get an RFE for this. I was actually thinking that this very thing (a prior arrest) would have allowed us to get an interview, instead of the NPIW. ? Edited by Tina and Johan
