Notice of Potential Interview Waiver Case [Part II]

Hi Shell! I just checked my email and I actually contacted the Ombudsman twice, January 20th and March 16th. When they replied to me yesterday, they used the Jan. 20th submission number instead of my March 16th inquiry.

Well Natonstan applied in January, but I know his local field office weren't working on his dates, so I am wondering if the same happened to you, that at the time of applying to the OMBUDSMAN, that you were still in the current, pretend, processing times with the USCIS? And perhaps the influx to the OMBUDSMAN this week has opened their eyes to what is actually going on here?

This is so cool, so they say within 30 days on the 2nd email, as it was out of processing time, so they do force the USCIS hands, with that in mind there will be approvals this week for the old timers. Great news!!

March 16th 2015: 10:04AM I got this email:

Good afternoon,

The Ombudsman's Office has reviewed your submission and contacted U.S. Citizenship and Immigration Services (USCIS) regarding your case.

Please be advised that in certain cases, it may take up to 60 days to receive a response to our inquiry. We will notify you when we receive information from USCIS.

If your circumstances have changed substantially, you may contact us at cisombudsman@hq.dhs.gov and reference your unique submission number 2XXXXX3.

Sincerely,

Office of the Citizenship and Immigration Services Ombudsman

My application was then approved

Then on the 17th at 12:58PM I received:

Dear Sir,

USCIS has indicated that it is actively reviewing the application or petition referenced in your inquiry and should issue a decision in this case within 30 days.

Please inform the Ombudsman at cisombudsman@HQ.DHS.GOV if you do not receive correspondence from USCIS within 45 days. Because USCIS has taken action, our office will be closing this matter.

Thank you for giving the Ombudsman’s Office the opportunity to assist you.

Then an hour later on the 17th at 1:36PM I got:

This message serves as an update to the email sent by the Ombudsman’s Office earlier today, March 17, 2015. USCIS has indicated that it recently issued a decision regarding the application or petition referenced in your request for assistance. If you do not receive the decision notice within 15 days, please contact USCIS at 1-800-375-5283.

Since USCIS has issued a decision, our office will be closing this inquiry.

Thank you for giving the Ombudsman’s Office the opportunity to assist you.

Now that I look at it, it is interesting to see the days drop within the space of a day! I never paid attention to the emails because I was approved after that first one so it didn't matter much, but I'm sure people will find them helpful

Now that I look at it, it is interesting to see the days drop within the space of a day! I never paid attention to the emails because I was approved after that first one so it didn't matter much, but I'm sure people will find them helpful

I think that once youre in the processing times, then you can send a request, I doubt they can do anything before that, perhaps you did it too early in Jan, as am I correct Dallas wasn't processing your times then? Right? I think once you past the local field office times they move pretty quickly and give the USCIS 30 days to sort it out! So I have about two months to wait before I can, as Pittsburgh are on July now, but I know they wont leap to the middle of August that quickly. I don't mind though, I just want my old timers getting approved, fair is fair!

I think you're 100% correct, do you remember me saying I never even bothered scanning my NPIW letter and attaching it? That's because I knew I was contacting Ombudsman too early but I thought I'd give it a try for the hell of it, so I just filled out the form, clicked submit and then obviously on Monday they did it :)

Yeah and Katexo, sorry if wrong spelling, did one in January, probably too early, but their approval was probably prompted by the reminder they did on Monday as they were probably over the processing times for their field office by then, even if the OMBUDSMAN did use their original enquiry. So I reckon within 7 days, we will see all the people who put an enquiry in on Monday get their GC, as long as they over the processing times of their local field offices! Exciting!

Ok Peeps, so Natonstan and I, have figured out if you are out of processing time, you can apply to the ombudsman and hopefully get your GC within 30 days, what Im not sure about is what happens with the stupid NPIW letter!

Honestly I'd say its NOA1 date because like you said processing times are going by NOA1 dates, I think the NPIW is just a useless piece of paper they sent out so that people didn't question anything for 6 months

That's good news, as that means Derwood can apply to the OMBUDSMAN as his field office say May 2014 and he filed in July!! If nothing else it will give the USCIS one big headache, which I can't say they don't deserve after the way they have treated everyone on this thread!

Daydreaming whilst I brew my beer. I suddenly imagined a hand coming out of the boiling wort holding my green card like the Lady of the Lake and Excalibur. I think there's more chance of that than an approval before my year waiting is out. Maybe I'll just drink all this and more in the meantime.

Another approval today, so that is three!! You need to go to the OMBUDSMAN, guaranteed to be approved in 30 days if you out of time at the field office which you are!! :)
