do i have get her to the usa and when she is in the usa how long i have to get married and do to file for a change of status on a k1 visa

You have six months to get her to the USA. The clock starts ticking when she completes the medical. So six months from the medical is the length of time that you have to arrive in the US as that is the length of validity of her visa. Not six months on the day or six months and one day over. Before six months is up, so watch your calendar.

Once she arrives you have 90 days to get married or she will be considered out of status and can be picked up and deported. So again, watch your calendar.

Next their is a need to file your AOS. Most file it right away after the wedding. If you go beyond the 90 days without submitting your AOS, she is technically out of status. Again, chance for deportation.

The guide is posted with the wrong information. The validity of the visa begins at the time of medical not when the visa is issued. This is relevant to the Philippines I'm not sure what other Embassies use. I saw a couple more errors. I'd suggest the OP stick with the answers from others who have gone before him using the USEM in Manila.

My fIancee's K1 expires 2 months after it was issued, which is 3 months after she completed medical.

Medical and interview in January, Visa issued in February, Visa expires in April.

Wife's IR-1 Visa was issued last week with the Expiration Date exactly 6 months after the day of her Medical at SLEC>

Get married within 90 days of arriving.

You can wait years to do Change of Status...

Yep. We paid for 2 medicals and got half the time.

I am sure that is the reason that your visa was only valid for two months is because of the TB treatment regiment.

I suppose. My fiancee's visa is only valid for 62 days. That is from the date of issue to the date of expiration. We left the PI one week after her visa was delivered by 2go. So I take that to mean we do not have 90 days in the US to marry, only 55 days. And not 6 months to leave the PI, but rather we would have had less than 2 months in order to get to the USA in time to get a marriage license and get married all in less than the 62 day visa validity.

Anyway, the wedding is Sunday so we are in under the wire. Hopefully the OP will get full advantage of those maximum days.

The clock is different for the visa validity and Marriage and they are triggered by two different responses. The visa is tied to the medical exam date and begins from there. I am not 100% sure why you didn't get the full 6 months but I am thinking it was do to the extended time of your TB process.

The 90 days for marriage is triggered when she lands at her POE and should be verified from the I-94. The expiration date of the I-94 is the benchmark for completing the marriage.

Ah, I see on her I-94 that it is valid a month or so after her K1 expires.

The moment she arrives in the USA her visa expires. Done! Zero! Nadda! As in NO MORE.

The I-94 kicks in and gives her 90 days to complete the marriage perameter of the visa. It's recommended that she keep her I-94 with her at all times till her GC arrives.

If she does not marry then she is what is considered out of status and hence has to return.

During her AOS application process, the application is proof that she is waiting for adjustment and she can remain in the country during that process. In fact, she can't leave the country or she will forfeit all rights unless of course you filed the I-131, Application for travel Document (TD) and she has that in hand then she is allowed to leave the country. Make sure you apply for AOS, EAD and TD. TD is free if filed with the AOS.

How does that work VOL? To wait years?

What I'm reading here is that the "admit until date" on the I-94 is good for 90 days upon arrival at POE. How can we wait years beyond that date to change status?
