OK,I'm getting really tired of all our delays and problems.......

Now I would like to know what could happen in case I go to see Jim and we get married?

Could we do AOS afterwards?

I know it's very risky business and I do know that usually I would have to leave the country again and we'd have to apply for a K3,but what if we'd get married and I'd stay in the US?

I'm not saying we'll do this ,actually I havent even talked to Jim about it.

But I'm really getting tired of being seperated from the man I love and want to spend the rest of my life with.With the new unexpected delay it might still be a whole year until we got the K1 in hand and I really go crazy by now.

Could somebody please tell me what we would have to face in case we try to do AOS right after getting married and I am in the US on a VWP I 94?

It is not illegal to get married in the U.S. You can travel to the U.S. as a visitor and get married. No problem here. You must then leave the U.S. and apply for a K3. Now given that you're already in the midst of the K1 process there's no advantage in terms of saving time to do this. You'll have to start anew.

It is illegal to enter the country to get married with the intent to stay here and subsequently adjust status. If you have a K1 pending it would be impossible for you to disprove intent.

In my opinion you would be denied adjustment since you had a clear intent to circumvent the U.S. immigration law.

As the previous posters already stated, it's a VERY risky plan and I can not recommend doing it. You'd have to prove them that it wasn't your intent to marry this man when you entered the States under VWP and I don't think* that all the binding ties to Germany that you could show them and all other evidence could offset the fact that you already petitioned for a K-1 visa (therewith showing an intent to marry).

We all hate to be apart from our loved ones, hate the waiting and the uncertainties... but it will all be worth it in the end!!!

What you are considering is fraud. You would be using the VWP with the prior intention to immigrate.

If i were you (which im not, lol) I would continue on your choosen path.

Like stated abouve you are already in the middle of the K! and marrying and doing K3, you would have to start all over again....with probably the same delays as this time.

I know the feeling of being away from the man you love, its been 6.5 months for me and we only just got the NOA2 last week!!

But for all this worry, seperation, to do it legally and with peace of mind that you have a right to be here cause you did the right way, its a pricless feeling i bet!!

February: Waiting..Contacted Congress

March 4th: APPROVED

March 17th: NVC posted file to London

March 20th: London Receives file

March 29th: Receive package 3

April 13th: London Receives package

April 19th: Medical - June 13th: INTERVIEW......APPROVED!!!!

June 20th: ARRIVE IN USA

Time taken for whole process 9 Months

Time taken for AOS - 3.5 Months

Finished for 2 years.

You would likely be denied AOS - if you get that far!!

With a K1 in the system and all your belongings in tow, I highly doubt you'd even make it in through the POE.

What you're suggesting is illegal, it's visa fraud and really not worth the risk - particularly when your K1 is moving along (allbeit slowly).

Something to possibly look into is getting married and filing with the consulate in Germany for a CR1 visa - I don't know if Germany allows this though, you'd need to check it out. Also check out K3 processing times - they may be better for you than K1.

We are all sick of being without the one we love, thats understandable, but dont risk losing everything now. Just TRY to be patient, everything will work out in the end. Delays happen, but in the end you will be glad you waited.

Well the OP is not in the 'system' as yet cos no papers have been filed but as we all know adjusting on VWP is only applicable if there was no intent.....at the end of the day if you chose to take this route it would come down to how convincing you are at interview stage.

I know all of you are right.I'm just so sick of all them delays at the moment.If we had the K1 application in already I wouldn't stress that much because it would only be the wait until we got the visa in hand and Nebraska and Frankfurt are pretty fast,but we can't even put the I 129 in at the moment since we just found out that Jim's divorce has never been finalized.

So now we have to wait for that to be done and THEN wait for the visa..........That's why I even thought about other ways.......But since that definitley is not an option since it's way too risky.......I guess I just somehow have to hang in there and get through this..........

Dawn-I wouldn't be very good at an interview like that-lol.

No news yet,will let you know once he got a hold of Sharon............
