If the waiver needed on a B1/B2 visa

Hi!

My friend's mother want to apply B1/B2 visa, she is been travelling to US on B1/B2 since 1988 and never overstayed. Last time when she was enetered into US in NOV 2000 on a B1/B2 visa she was allowed to stay for 6 months.

She did not left USA till NOV 2001(11months stay), her USC son recently sent her I-134, invitation letter, job letter, US passport copy, bank statement. Her son is planning to change her status once she is in the US to permanent residence. She lost her husband 2 years ago and her only son is settled in the US.

She already submitted her application at the american express courier service and dropped her passport for the interview.

I need some help here what to tell the Consular officer if they ask her why she was overstayed and will she needs a waiver or not? She was overstayed for 5 months basically and that was more than 5 years ago in 2001.

B2 - Waste of time and money.

He should apply for her to Immigrate, I take it that he is a USC?

There is no waiver available when you are applying for a tourist visa. My opinion is she will be denied a tourist visa because on her last tourist visa she overstayed. I agree with Boiler that her USC son should apply to sponsor her to come to the U.S. permanently. In that situation, she would most likely not need the waiver due to the fact that she overstayed less than 180 days. However, if she did overstay more than 180 days then she would need a waiver approved. They can go ahead and apply for a tourist visa again and anything is possible, they could forget the fact that she overstayed on her last tourist visa and give her the new one.

08/18/2006- NOA 1 date

08/22/2006- Touched.....:)

10/25/2006- Touched.......BIG SMILE :)

10/26/2006- TOUCHED AGAIN..........HUGE SMILE!

10/27/2006- NOA 2 approval email received!

10/31/2006- NOA 2 received in mail.........Can't stop smiling!!

11/16/2006- NVC receives my petition and assigns us a case number CDJ----------!!!! WOOHOO

11/20/2006- Mailed to Juarez!! Yippee!

11/30/2006- Juarez received my petition......Email confirms I should receive my packet within 2 weeks!! :)

12/15/2006- Received Packet!!!!! Booking travel arrangements!!!!

12/26/2006- Medical Exam

12/27/2006- Interview, 601 waiver needed

01/10/2007- Filed 601 Waiver

01/17/2007- DHS Receipt of Waiver

08/26/2007- Approved

09/04/2007- Received Approval Notice
