HELLO GUYS,

WANTED TO KNOW THE DIFFERENCE OF CR1 AND IRI..MY HUSBAND FILED A PETITION TO ME FOR K3...BUT THE 129 F WAS STILL PENDING NOT YET APPROVE..BUT THE I 130 WAS APPROVED ALREADY..WE FILED THE DS-230 FORM 3 WEEKS AGO..DONT KNOW WHICH STATUS ARE WE IN NOW...WAS IT CRI OR IR1?THANKS AND GODBLESS!

How old your marriage is. If you are less than 2 years then CR1

The difference between IR (immidiate residency) and CR (conditional residency) is that the IR give you a 10 year green card, where as the CR visa only gives you a 2 year green card. The determining factor for eligability of an IR visa is how long you have been married at the time of the interview. For an IR visa you would have to be married for more than 2 years, if you don't meet that requirment you'll be given a CR visa.

If you get a CR visa, once in the USA, 3 months before the CR visa is about to expire you can apply to remove conditions and get the 10 year green card.

A CR visa is used to ensure that the marriage is not fradulant. When applying to remove conditions both husband and wife need to sign the application and attend the interview together. Additional evidence of an "on-going" marriage is also required. You can get more information in the forum that discusses lifting conditions.

IR-1 is Immediate Relative visa and results in a 10 year permanent green card being issued, this applies to couples who are married more than 2 years at the time of the visa interview.

CR-1 is Conditional Relative visa and results in a 2 year conditional green card being issued and then having to file to lift the conditions within 90 days of the expiration of the green card. This applies to couples who are married less than 2 years at the time of the visa interview.

I've heard many times that the marriage must be 2 years old at the time the visa is activated at the POE. I was actually considering having my husband wait a month to come down if it meant avoiding having to remove conditions.

Yes from my reading on VJ that say u get a cr-1, but by the time you cross the POE and avtivate ur visa, its now been 2 yrs of marriage, you would be elgible for the IR-1 visa,thus a 10 yr greencard. Never bothered to look at the USCIS site, just what others have posted.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

If you have a IR1 10 year green card, can you travel outside the US immediately?

if one has a cr-1 they can travel out asap as well, (same for a K3 I belive, but i did not go the k3 route). Point I was making was that at the time of the interview a couple may be married for 1 yr 11 months, thus issued a cr-1 visa. By the time he/she crosses the POE and activated the visa, it may be 2 yrs or more, thus from my readings on VJ, they should be issued a IR-1.

Yes, you can travel on a 2-year(CR) or 10-year green card(IR), or a K3.

While there are restrictions on the Green Card dealing with abandoning your status, or long trips, which one should review upon receiving a Green Card, simple travel is not prohibited.

The classification of the visa does not determine the classification of LPR status. Visa classification is determined at the time the visa application is approved, LPR classification is determined at the time of entry.

The visa 'expires' after 6 months or when the person enters the USA, whichever comes first.
