I-130 filed in Delhi, waiting to hear from Chennai... Please guide me.

Hi Friends,

I have filed I-130 last week in Delhi.

The lady at the winow said we will hear from the chennai consulate within 2 months or so !

Now I have some questions regarding what next..

What they told us is to wait for the response from Chennai.

If anybody tried filing in Delhi and waiting to hear from chennai: how long did it take for you to get the packet 3?

did you do some follow up after your filing? if yes, could you please send me the email/phone# for communication?

Regarding afidavit of support, since my wife is not working here in India, we need to get the income of her parents(household members I 864A)

Is it needed for them to notarize the I 864A, since they are sending it from the US?

if she has a bank balance of 16500 USD which is the 125% of the poverty line income, would that be enough? It might be safe to include the income of her parents too right?

I can get an offer letter from the head quarters of my company which is in Washington where I can continue my job in the US. Can I include that in the aphidavit of support?

Since the objective of this is to make sure that I wont be a public charge :) , An assured job offer would be a possible item to include. So is there a way I can include it?

I really appreciate if anyone could shed more light on these questions.

I may be wrong, but I believe the Affidavit of Support has to be from the petitioner - the US Citizen. I don't think the beneficary - your wife or her parents can be the sponsor.

05/24/07 - Interview date at Mumbai consulate - APPROVED!

06/02/07 - Mumbai - Paris - Atlanta - Charlotte. Departs June 1st 4.45am EST Arrives June 2nd 4.12pm EST

07/10/07 - Received Conditional Greencard. Still waiting on the SSN

Congrats on successful filing. Got your msg too.

I will try to answer most/some of your questions based on my knowledge.

- You will get the packet 3 from Chennai within 4 to 6 weeks. If you dont hear from chennai within 4 weeks...contact them abt your case to make sure that they have your case and they are working on it. (you shd be able to get thier phone/email from chennai consl web site....)

- As per new law, 864 Doesnot need to be notarized.

- I am not sure if you are petiotioner or beneficiary but petitioner needs to file the affidavid of support. Petitioner needs to show the current earning enough to cover his family size as explaing in the instruction of 864. If the current earning is not enough to cover...petiotioner can either use the assets in liue of earning or cosponsor. The assest must be 3 times the poverty guide line reqmt for the family size. you can use bank balance, real estate, stock, bonds etc as assets. If there no enough assets, than its almost necessary to use the cosponsar from petitioner's family members. ( I recommed you to go through the 864 instruction so that you will get more clarity on all these issues....)
