Possible problem with sponsor.

So my wife is a American Citizen and she will sponsor me with her mother. The problem is that I just found this today:

If the petitioner does not have a domicile in the United States, can a joint sponsor file an I-864?

No, the petitioner must meet all the requirements to be a sponsor (age, domicile and citizenship), except those related to income, before there can be a joint sponsor.

Well, she is living for a year now, in Brazil, with me, and she does not own a residence at US. She lived with her mother before. The only thing that she still have is a Driver License and a Bank account.

Should I be worried? This will be enough?

*She never filed tax before, she is 19 and never made enough to do so.

ya, there is wording in the I-864 and I-864 instructions that cover domicile proof in usa.

there are 2 paths for this:

1. showing proof of usa domicile or

2. showing proof of steps done to re-establish usa domicile.

if not have either during NVC doc intake, that's ok - but must show this proof on/by interview day at the IV unit.

To have it, show it, for I-130 submission is silly, given your exact situation, so don't try to have it 'done' when submitting the I-130.

the problem is, we are not planing to have our own domicile for a while once we get to US. I mean, we are going to live at her mom's house for at least 4 to 6 months after getting a job etc...

My I-130 was are submitted and approved, and I didn't send any docs showing proof of domicile.

A letter from her mom saying that we are going to live under her roof is satisfactory? Plus her active bank account with statements that are sent to her mom's address? driver's license and SSN?

Would be wise of me think that this requirement can be more strict depending on what consulate you are on?

After reading a few posts here and there I came to the conclusion that Canadian's consulate are really picky with this matter!

But yeah, I think I have some documents that are needed covered and a letter from my mother-in-law saying that we are going to live with her for a while is really valid too!

suggest getting a cable-tv account set up in her name, prior to interview day. utility bills at location are great - but since it's a mom-thing, probably not going to shift the bills into her name [electricity, water, gas, etc] - a cable-tv account is easy to get or shift.
