Ok so I just got my email from CRIS stating that my I130 was approved. It states that there will be instructions in the notice. I never received NOA 1, so I never started the !-129f app. I wanted to know what is my next step with this approval? I sent it in on Nov. 15, Sent NOA1 on Nov. 21 2006, Approved on Feb. 8th 2007.

This occasionally does happen. For us we did not get the NOA2 for the I129F we however choose to file the I130 and followed the IR1 path. Even though you are slightly late in filing for the I129F in the sense that it is usually filed alongside the I130 however you can still file it if you want. Hope this helps.

Congratulations on the approval :)

Are you sure you didn't receive the NOA1 "receipt notice"? What was it that you received on November 21?

Most people in your situation would not file an I129F after having the I130 petition approved. At this point, filing the I129F would have a small chance of reuniting you sooner, and even so the beneficiary would still have to apply for employment authorization which takes an average of 3 months.

Take a look at the timelines and decide for yourself :)

Finally, for what happens next... please read the NVC Timesavers Thread pinned at the top of the NVC forum, as well as the NVC Flowchart in the Guides. I read those several times until I had a good understanding of the process.

Thanks for your help and support.... It seems like my I130 was approved fairly quick. Less than 3 months, it seems tha i t has taken people longer. What I dont understand is on the processing dates for the California Center, they are currently processing cases with a receipt date of July 17th, 2006. I sent mine in on November 15, 2006.

I will be reading the process for I guess a CR1 visa.. I will not be pursuing the K3 visa any further, since I am not going to send in the I129f packet.

No, once the I130 is approved it is forwarded to the NVC (that is unless you also have an approved I129F, and then the I130 will probably be retained).

Processing at the NVC usually takes 3-4 months or more depending on how quickly you respond to their requests. When the case is complete at the NVC either the NVC schedules an interview or forwards it to the consulate for scheduling depending on the country.

So once the I-130 is approved do you just sit back and wait for the consulate abroad to send an interview date??

WOW! really!? ######, so in this case its taken 3 months to approve I-130 then could be an additional 3-4 before the interview and return back to usa... ######! i really thought after the I-130 was approved it goes pretty quick. That kinda puts a damper on the good news of the I130 being approved so quick. Oh GOd :'( will i ever see my wife and kids again :(

Unfortunately it's true.. look at my timeline, my I130 was approved December 6. I'm still expecting another month before my case is complete, and then another 2-4 months for an interview in Montreal.

But anytime something goes quickly, it definitely speeds things up :) It helps to be very prepared about the process at the NVC, you can save a lot of time by using James' shortcuts.

It seems like the consulate in Columbia has a fairly good turn-around time for IR-1/CR-1 interviews. If I were you I'd stay wit the CR-1 visa.

We had our I-130 approved before the I-129F, but we decided to go with a K-3 visa because Mexico takes forever with CR-1 interviews (10-14 months!). We should only wait 3 months or so for a K-3 interview.

Yes, it's hecka ridiculous. In hindsight it would've been better to do a K-1 fiance, but at least there's s K-3 visa. We actually don't mind waiting 3 months for work authorization because Guillermo should arrive before my summer vacation (I'm a teacher). :star:

It's totally optional.

In the directions for he K3 it says after you receive the NOA1 for the I-130 you should send in the I-129F....

Is that not necessary?
