omg i am up to here with the house buying stuff. so the last that happened was the deadline on our previous offer expired and the bank rejected the loan officer's request for an extension (apparently the reason why that happened is because the loan officer called for the appraisal late, and then the appraiser filed the documents under the wrong category so both of those combined led to the loan not being cleared in time).

a new offer was supposed to be resubmitted on the first of the month, and jonas signed all the paperwork on that day itself. our contract spelled out that the seller has 48 hours to respond to our offer. we've tried so many times to get in touch with the real estate agent and the loan officer but have only started hearing back today.

so now the loan officer needs some new paperwork and apparently ONLY TODAY, our offer was accepted. how is this ok? doesn't 48 hours mean 48 hours?

also, loan officer at first assured us that the new offer paperwork would all be done and ready for closing in UNDER 2 weeks. the real estate agent called us to say that he would advise putting 3 weeks just in case. i said no, two and a half weeks is the most we can do because if it drags beyond that, we will effectively be homeless, since our lease is up on the 18th and any time after that, we're not going to go ahead with the sale and just sign another lease. he said fine, he'd put the closing date as the 18th (which would still be pushing it, cos what, are we going to move in the middle of the night?). so now the loan officer has sent us an email that says she told the real estate agent to put 3 weeks anyway "just in case" and they went ahead and changed the date on the documents jonas signed and submitted them. isn't there something inherently wrong with this?! and if the closing date does end up being on the 21st, i guess we will be renting a motel room somewhere with all our stuff, just hoping that another "extension" isn't filed behind our backs.

Can you ask your landlord for a month to month extension on your apartment?

we already did and they said no because they only have a max of 2 month-to-month rental agreements and both slots have been taken. if we had asked back in early march, maybe. but the loan officer didn't even tell us that we wouldn't be able to move on the 31st until AFTER we'd given our 21 days notice to our landlord.

I dunno how things work there. But here, when your lease expires, you simply become what is known as a "holdover" tenant. No recourse, and no one is coming to evict you....

so you're saying that we can just stay without the landlord's approval? what if they rent it out to someone else and that other person wants to move in (which they are claiming)?

Even in your state, tenants have rights. A lease is usually geared for the protection of the renter.

Yes, they can't just come and throw you out. A court has to order you out. It usually takes at least a month. In NYC, it takes about 18 months to evict.


Commercial leases are geared for the protection of the landlord.

it's nice knowing we have rights. but realistically, i'm not gonna do that. i don't want to get into a confrontation with the landlord when he comes over to ask why we still haven't left. if our lease expires on the 18th, we will be honoring it and moving ourselves and our stuff out. it just sucks to be in such a time-sensitive situation, when i see so many instances where it could have been avoided.

jonas is gonna call and ask his parents if we can store our stuff in their workshop and then he and i and the cat can get a room if it comes down to it.


and the hamster! i can't believe i forgot about the hamster. :oops:

There won't be a confrontation, the police can be called for "illegal eviction". (Google that law for your locale).

The procedure is, when you fail to vacate, they have to have an attorney send you a letter to vacate. And that timeframe is usually 30 days. After which, they take you to court. And I'm pretty certain that as long as you're paying the rent, no court will order you out.

There are also different provisions for multi unit dwellings.

Such as they can't say they need the apt for their own family. Whereas say if it's a 2 unit dwelling, they can use that as reason to evict.

:lol: my real estate agent is familiar with only one thing, and that is telling me not to worry. the only reason we still have him as our agent is because he handled the sale of this house from the beginning. if this deal doesn't come through, then we are looking for a new loan officer and real estate agent.

It does not sit well with me to overstay the lease and after the landlord already said no to extension.

Morally not right and don't want to end the business relationship on a bad note.

I know, good (stupid) people will finish last.

agreed. i just couldn't do it.

besides, what if the sale doesn't work out? at this point i'd believe anything. then we'd have to either renew our lease or move in someplace else and everywhere here asks for previous landlord references. just makes sense to move out on good terms.
