Your best chance with ESTA, not sure how much you know about the interview but our going back and forth is much more than you would get at an interview.

Not necessarily. I said that because based on what you've said it does appear that he does have some solid ties to his home country. With a different CO the outcome could be different. It's not a completely hopeless case imo, I've seen people post here with a lot less. The other hurdles for a person from a VWP country to overcome after strong ties to home country is why does he need such a long time to visit the US and how can he afford it? Why wasn't the 3 months sufficient? You've got to look at it from the CO's point of view. Not many people can afford to be away from a home they intend to return to for 6 months.

The main reason we wanted to spend so much time in the US together is so that I can get my first job (after graduating college), and so that we can take major tour of the States. We were just planning on having him hang out, exploring the city we live in, and being a house husband while I worked. He can afford it because he makes £400 a day right now in his contracting job and has been saving up a gigantic nest egg just so we can be comfortable on this trip. We honestly just thought 3 months wouldn't be enough for both me to have a job and for us to have a huge road trip.

Even if you don't intend this, I'm really glad you're asking these questions because I think it's really helping me to organize our case details better so we can be much better prepared for the next interview. :-) So thank you for that!

Yeah.. I'm painfully aware of how short the first interview was unfortunately. But I'm hoping if we can get all of this proof in writing, the documents will speak for themselves!

Glad I could help. I do agree with Boiler that in the long run, reapplying for the ESTA will be his best bet, unfortunately you'll have some time before he can use it again. If he's got the money to give the B2 another shot, that's all he would stand to lose is the money.

I appreciate your quick response, but you didn't really answer any of my questions.

In six months I will be back in the UK with him anyway, working on my Master's degree here. :-) This is strictly for a summer vacation in the States.

Based on the bolded above, I would say definitely give the B2 another shot first. He probably won't be able to use ESTA for about 6 months anyway, so you have the time to try the B2 again and if refused he can reapply for the ESTA before he will be traveling to the states again.

My two cents from someone from a VWP country. Once your B visa was denied, he cannot use VW again ever (and you mentioned this). The only option he has is B (and he did apply). ESTA will not be approved because he's been denied at least once. There are several ways to get the situation changed. One of which being that he gets a job and he can have his supervisor/employer write a letter indicating he's coming back after a certain period of time. This is one way to show he has strong ties to the UK. I cannot think of anything else. A letter from a family member isn't good enough.

Now that the U.S. consulate is suspicious of his visa application activities, he needs to be honest. He really needs something to show that shows his life situation (got a job) has changed, and that he can prove to the CO that it's plausible. Just to be realistic, a trip to the States doesn't like like a doable plan. But it might happen. Who knows.

Thanks! :-) We'll take our time to formulate a concise, ironclad (as possible) case for another B2 interview, and if it doesn't work, we'd only have about 2 months apart in the summer (my UK visa right now is good until June) before I'll be back here anyway to study.

Should we update the ESTA now anyway? And if he's denied, then assume the roughly 6 month waiting period on it will begin?

Yeahh seems like people have this random tendency to drop into these threads and post stock responses without really reading about the situation first. xD

I really appreciate you and Teddy's attempts to thoroughly understand our situation and try to offer us some advice. We will look into the ESTA again like you suggested, but also give the B2 a try again as well. We haven't really got anything to lose at this point, cept ~£100 for another interview, hah. It's worth it. :-) But we'll put our work into preparing first this time!

Small update:

He's just reapplied for the ESTA and actually wasn't denied outright, rather, got an "application pending" message that said his application would require up to 72 hours of additional processing. We're keeping our expectations realistic, but at least it's not bad news :P
