U.S. Supreme Court justices weigh challenge to Obamacare

WASHINGTON (Reuters) - The U.S. Supreme Court heard arguments on Wednesday on a second major challenge to President Barack Obama's healthcare law, but no clear majority was immediately apparent in the case that takes aim at a pivotal part of the statute providing tax subsidies to help people afford insurance.

Conservative Justice Anthony Kennedy, who often provides the deciding vote in close cases, said he saw a "serious constitutional problem" with the arguments mounted against the law but said the challengers still may prevail.

It all depends on whether or not Roberts crafts another obscure justification for keeping the tax subsidies in place for non-compliant states despite the plain wording of the statute.

Good intentions don't make good law and good economics. Just like Gruber the duber said, it won't work if the states don't follow in goose-step, or words thereof. And some 37 states didn't want nothin to do with it. Oh, my. Apple pie.

In the two or three months it will take the SCOTUS to rule, maybe we will see the dems reach across the isle. You think? Nah, me neither.

Technically only directly hits the subsidy on the policies (Tax Credit on Premium and Silver Plan out of pocket reduction) . Many self employed and others do not take any subsidy but use the full priced marketplace plans. I don't know the breakout of subsidized versus unsubsidized marketplace plans without their own state exchange.

That being said, if the subsidized members cannot pay the full premiums in the event of finding, then the population of the exchanges would become much lower and they could become insolvent and potentially unable to handle claims from those who are paying.
