Hello Everyone,

i have few questions about Affidavit of Support I-134 and hopefully this information and topic will help people for the future.

I am a SELF EMPLOYED PERSON. i own my own business.

1. how many years of taxes i have to include with I-134 submission? which number-line in taxes will be looked at? is it line 22?

2. what is form I-864 ? for consulate interview we need I-134 or I-864??

3. my last year income was 21,810$ ... it is over the %125 poverty line. so i can be fine with this... what do you think? i have around 17000$(checking 3500$, saving 13.000$) in personal bank account and 30.000$ in my business bank account.

4. how many months of bank statements i have to include in the I-134 package?

in the form it says "I have on deposit in savings banks in the United States" : should i only put my personal bank account balances or since i own my business i can include business account too?

and it says i need to get a letter from bank. does date matter ? my balances does not change too much but date mattters or not for the letter?

5. it asks "I have other personal property, the reasonable value of which is " can i include motorcycle and motorhome titles that i own?? what else i can put for this?

6. for the question 10 on the I-134 ... DATE SUBMITTED part ... is it when they opened my case and gave me the receipt date? or what i should put for this?

7. for question 11. there is a box for INTENT or DO NOT INTENT what to put for this ( this is very confusing what they are asking for ??)

8. Oath or Affirmation of Sponsor

I acknowledge that I have read "Sponsor and Alien Liability" on Page 2 of the instructions for this form, and am aware of my responsibilities as a sponsor under the Social Security Act, as amended, and the Food Stamp Act, as amended.

Hm. I've heard that you don't have to send the original, its on USCIS website actually. But I don't know how CO will respond to a copy.. Because I've tried to send a letter to Russia couple of times and it got lost...

Our visa journey has hit a yield sign. My future-father-in-law's health has declined in recent months. My guy took a few days off school to go back home after his father and other family brought dad to Peshawar for medical treatment. The family may move to Kabul, which would be nice for all our visa stuff.

We are waiting to see when my guy's final exams will be, but we went ahead and scheduled his medical for June 10th. We may need to reschedule it because his final exam dates are not posted yet.

Even if we get the visa and no AP, we are not sure at this point when he should come here. We want him here soon, but time with his family now is important. So, we are contemplating a trip to visit each other in August if we decide to delay his entry until November. We need to see each other soon, but funds are not unlimited.

If we get AP, we will definitely plan another trip to Dubai. If we don't, we will delay buying his ticket and see how his dad is doing. I tend to hate buying tickets later for fear the prices may increase. The flight prices already increase the second and third weeks of August to Dubai. Why? Isn't it hot enough to melt your sunglasses??

But I just wanted to vent here a little. I knew to expect instability during this process. We sure had it when we were trying to schedule our first visit and had to reschedule three times because of an attack in Peshawar this past December; we didn't know when his final exams would be.

The thing that is important is that his petition is there. I have always said that when we pray over this visa, we shouldn't ask for the visa to get approved quick, but get approved at the perfect time. Our perfect time isn't known to us at this time.

how do I know I'd the case is ready and at embassy ? I mean sure I need the case# first ..but at what website have I to sign in to see what's happening with the case at the nvc?

I got a great deal in March on my ticket to Dubai. Only paid $1,960.00 for a direct flight on Emirates out of DC. That included 7 days in a 4 star hotel. I looked again this month and the price has tripled. I guess they think this is their busy time of the year.

how do I know I'd the case is ready and at embassy ? I mean sure I need the case# first ..but at what website have I to sign in to see what's happening with the case at the nvc?

You check ceac.state.gov and select Immigrant Visa. It's strange how it's a non-immigrant visa, but it's quasi-immigrant to DoS. I thought we could pay the visa fees online, but we can't.

I got a great deal in March on my ticket to Dubai. Only paid $1,960.00 for a direct flight on Emirates out of DC. That included 7 days in a 4 star hotel. I looked again this month and the price has tripled. I guess they think this is their busy time of the year.

Wow, tripled? Ouch. Good thing you guys got it when you did!! Prices for September are reasonable right now, so we will see. His flight is going to be the same price regardless. It's the Dubai to Dallas flight that is the most expensive. I would like to stick to the $1,000 to $1,200 range, but your package sounds like a good deal.

I'm also trying to finish my last two CPA exams by July, and if I need to retake either of them, I need to do those by this November before I lose credit on the first exam I passed. It's like we have all these things flying around our heads - which one will prevent us from moving forward and which one will be easy? Oy vey!

I haven't looked into it too much, so you may want to double check EVERYTHING I mention here, but I wanted to answer your post - maybe help a tad.

1) I've hea)rd three years is good if self-employed. I will be sending the last three years although not self-employed. I'm waiting on my 2014 transcript now, then will overnight the documents and photos of each other. Line 22 of which form?

2) Form I-864 is the Affidavit of Support we send when we send the documents for adjustment of status from K-1 visa to resident alien (green card). That is the binding one. For some reason, Form I-134 is not totally binding? For fiance's we need Form I-134; but spousal visas use Form I-864.

3) You didn't mention how many people are in your household - so I will assume it's just you and your future spouse. If your profit from last year was over $19,921, yes, you should be good. You may want to see if your last three returns reflect decent profit similar to this as well. Maybe even check that year's (the past year 2011, 2012,and 2013) poverty line, just in case they consider the poverty lines in the past. They might not, but I would do that just to make sure to avoid surprises. The cash is your assets which will help. The business cash may only help if you filed as a sole proprietor, but that may be a business/tax law technicality that the consular officer may not consider.

4) I would include at least twelve months of bank statements. What I would do (you may want to consider if your embassy is 'easy' or 'hard' - I'm gonna treat mine as 'hard') is provide all bank statements from 2014 (calendar year) and/or the last twelve months from the date on Form I-134 (rolling year). So if you sign it in May 2015, I would include January 2014 through April 2015. I would think you could include the business accounts too, especially if you are a sole proprietor; then those are officially your accounts too. If incorporated, then that is technically a different entity's cash, but you own and control all 'stock' in that corporation. If you are an LLC, you are a sole proprietor unless elected to be treated as a corporation on your federal tax return only. I don't think the date of the letter matters. When I called, my bank said their letter would only have the date I opened my account, not the average balance. However the average balance can be ascertained from the statements - a stable cash balance level is a positive thing (I think).

5) Yes, include your home and transportation. Personal property is anything that is not real property (land and attachments to land) or intangibles. So include a reasonable amount (I would estimate on the low side - maybe a few hundred dollars if I spent $2,000-3,000 for new items) of furniture. Look around you - if you were to sell EVERYTHING, how much could you sell it for at a yard sale? If you were to walk into a yard sale with enough money, what would you buy your stuff for if you needed and liked everything you were selling. Don't forget art, patio furniture and durables (washing machine, dryer, refrigerator). Again, use a dirt-low price. You may have really, really nice stuff, but it's used and may have a few years on her.

6) Gosh, good question. I put NONE since I've never filled one out for anyone else; I thought this was just for people that have filled out a previous K-1 visa petition. I didn't think about putting the current fiance on here. Let me know what you find out...maybe open a thread on the appropriate forum or search to see if this question was asked before?

7) I think some people using a co-sponsor would put "DO NOT INTEND" because they can't afford it. If no co-sponsor, check "INTEND" if you intend and are able to support your fiance. I included on my line 11, "I intend to furnish any and all necessary living expenses for ___, including and not limited to, housing, meals, clothing, health care, transportation, educational and miscellaneous expenses for the rest of our lives." (I didn't think it was necessary to mention that my fiance will eventually work...)

8) I was wondering this too! I just typed my name. I figured no harm in typing it, but if they want to see it and I miss it, the harm is done!

I can Answer Question No 2 , 6 , 7 and 8 only .

Ans to Q 2: I- 864 is for spouse visa and I-134 is for Fiancée/ Fiancé visa .

Ans to Q 6: It is the date when you dated the I-129 petition and sent it off + don't forget to write your fiancé/ fiancée name (beneficiary name)
