Hi everyone,

A little update, I jus checked my i485 online status, it says USCIS is ready to schedule me an interview as today of 4/27/2015.

I feel so happy, and hopefully I wont get RFE.

That is awesome. We have the same timeline, i hope mine case speeds up too.

And about your interview date, i read around the forum... when scheduling is complete, you will receive a notice with a time n place for your interview. This will vary by offices and is largely determined by the number of cases ahead of yours. Good luck to all of us!

Congrats on the update. This probably means that you won't get an RFE until your interview because case has been transferred to local office. It seems like that cases are moving quite quickly.

Now the local office will schedule your interview based on how much applications they are dealing with.

I don't mean to burst your bubble but there are people around the forum who have been or were waiting to be scheduled for 3 or 4 months. Sometimes you get the interview date within a month. Sometimes they tell you the interview date directly without updating your status to scheduling.

We got the rfe in hard copy, actually it's a request for "initital evidence". It has 2 parts:

part 1: asking for my hubby's w2, 1099...etc. This is kinda confusing as I sent his tax transcript for 3 years including 2014, look like they also want other paperwork (new to me, i thought transcript would suffice).

part 2: stating that we do not meet the poverty guidelines. My hubby is currently looking for job, and I'm working as h1b visa, and I sponsor myself but I guess as my visa expires 2016 it won't help. So we will ask for help from my father in law. My question is, I already submitted I-864 (with hubby as the petitioner and combined with my h1b income), now we have to include I-864A with father in law income, so do I have to submit I-864 again? Also he's self-employed so can he write himself a letter to state how much he makes? Thanks for any input!

what was your household size? And uscis clearly state transcript doesnt require w2 and 1099 and self employment sponsorship is very tricky they go by net income from my understanding

For Part 1; Well if you read the instructions for I-864, they do not ask for W2 but they do say something like showing proof of income is good. So you should always send W-2, with tax transcripts to show proof of income. Also if you file Jointly, W-2 is the only way to seperate the income of joint filers for USCIS.

For Part 2; As I advised you earlier, its tricky to use your own income because you need to prove it will continue after getting GC. So you need a joint sponsor. Your joint Sponsor has to fill out their own I-864. DO NOT SEND AN I-864A for joint sponsor. They will have to fill out their own I-864.

Now I do not know how a self employed person can show proof of their income. Maybe transcripts and an explanatory letter, but I suggest you ask this question in the main forum instead of March filer forum. Obviously More people will look at your question there Maybe someone there would look at it and will be able to help you.
