Hello,

I am a little confused with all the literature here and i have printed out everything on this site and others.I am in Japan and I live in osaka.

I wanted to know which way is faster to get my wife into the US..from Japan. My wife is chinese but we were married in Japan(almost 3 years ago) and we live in Osaka japan.

If i am right, i can do the k3 or DCF..but i wanted to see what way is the fastest and least time consuming.

I have completed almost all the docs except for the tax documents...(tax questions, i believe i need to get my wife an ITTN number because i cant get a ss # yet for her..right??) I am going to file my taxes(exempt)for last 5 years..so i think i need to get her a ittn number..right??

Is there a time limited/expiration on the medical records(She completed the docs last april of 06??

Ive read that i now have to file the i-130 in the us office and not to the japan us em/consulate.Do i only send this I-130 document 1st??is this correct..just the I-130?? or should i send more?This is were i read things and i get confused or i feel almost retarded..sorry :)

Is it true that i need to have $80,000 us to sponsor my wife since we are currently living in Japan? We made $50,000 dollars together last year...we both made about #25,000+ each.Im not in the US..so will i need someone to sponsor her since im currently living in Japan and i dont have a job waiting for me in the US.

Wedding document translation?? Can I do this?? We were married in Japan and thus the document is in Japanese. Can I or my wife translate this and then get it certified at the osaka us office??

Yes, you will need to get an ITIN for your wife.

With the I-130 form you also send in G-325A packs for both of you, along with supporting documentation noted in the instructions.

If you want to try for the K3, after you get teh receipt for the I-130 you send in the I-129F form, along with another set each of G-325As and supporting documentation.

No, you do not need to make $80,000 to sponsor an immigrant. You need to have though at least 125% over the poverty line in annual income, and a home to put her in. If you have someone who will be joint sponsoring with you, then they will need to have an income of 125% over the poverty line for the number of people in their household, plus your wife. Both you and the joint sponsor(s) will need to complete the sponsorship forms when it comes time.

You will need to show them that you have somewhere to live once you get to the US, whether that is with friends or family they don't care, but they need an address.

Yes, anyone fluent in both languages can translate your marriage documents, and any of your wifes documents that are not in English. I believe there is a template letter around here somewhere that you can use that just says it was translated by whomever and they are fluent in both the original language on the document, as well as English and they state it is correct and blah blah blah. I don't think it needs to be notarized or anything, but check with others who've had to do the same.

Today, i got a notarized passport copy so i can apply for her ITTN.I think i have to fill out the tax documents 1st and then try and apply for her ITTN with the complete docs?? is this right??

Does anyone know how long it will take to get her ITTN number? After, this how long am i looking for the IRS to process our taxes?(2 years where just me, and last 3 years we will be filling jointly.)

I got a copy of the marriage cert template from the osaka govt office so i will get it notarized next week.It cost about $40 in Japan.I did have a question on the translated marriage cert..at the bottom it said seal...so i wonder if i just need to write the name of the guy who signed(used his honko..japanese signature)or do i need to go to the japanese govt office and get this guy to sign his signature on my english translated marriage cert????

Question about sending I-130 stuff....do i need to actually send my wifes passport with all the info?? Because they have changed the loacation,last year i could send it to Tokyo but now it looks like i have to send it to the USCIS office in CA???

I believe you can send in the ITIN application with your federal tax return, and if you have any state taxes to file, you have to wait until they send you the number back before you can file those. If you don't have to file state tax (you're not living here, so I see no reason you should) you're good to go.

I don't know on that one, someone else who had to do translations would be better to ask.

Do not send originals of any of your supporting documentation, send photocopies! If you send originals, they'll lose them and you won't get them back!

DCF is no longer an option, it was "temporarily" discontinued by the USCIS a month or 2 ago. You can send both the I-130, and then the I-129F to try for both the IR1 and the K3 and see which one goes quicker. Or just send the I-130 for the IR1 and wait.

With the K3 you will use the affidavit of support I-134, at the interview stage, not with the petiiton package. For the IR1 you will use the I-864 affidavit of support, at the interview stage, not with the petition package.

You can use your parents address as your US address. As for income, you will not have income once you leave Japan, so they will want to see that you either have a job lined up, or you'll need a joint sponsor.

read on another VJ site, that DCF may be opening up again. But of course its not a fact, just what another poster stated!! If one can DCF, thats usually the fastes route

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I dont know how it is in Japan but at Embassy in Bucharest since they have Romanian Staff they are willing to accept untranslated Romanian documents. (assuming DCF goes back up).

Also dont forget to have proof of relationship . . .pics, phones calls whatever you wanna show.

Anyhow here is a list of Documents copied from the US Embassy in Buchaest stating everything you need.

the I-130 now requires reltaionship evidence with the form submission.
