We filed for the EAD & AOS on 23rd March 2015, and had our bio-metrics on 22nd April 2015. And, a day later we had a RFE saying out AOS is put on hold, we got the letter yesterday and it says the joint sponsor doesn't have required income. The joint sponsor files 1040 form, and he's self employed he makes well over required. I bet they are looking at adjusted gross income instead of gross which doesn't makes sense because he files 1040 form.

And, do u think that RFE will effect EAD? on the RFE it's just our AOS case number.

In case of a RFE, everything is put on hold until they receive the required documents they asked for. So, yes it affects EAD.

For self-employed, the income they use is line 22 of the 1040. Are you sure you submitted ALL the correct tax forms? For I-864 either a copy of a complete tax return (all pages of W2, 1040) OR a copy of IRS Tax Return Transcript is needed.

Sometimes the wording of RFEs can be confusing. They can send you an RFE saying " based on the documents you submitted the sponsor/joint sponsor doesn't meet the 125% of the poverty guidelines" for numerous reasons:

1. missing tax documents

2. missing additional evidence (recent paystubs, employment letter)

3. or if you submitted 2013 tax papers as the most recent one, they might just wanna see the tax papers of the year 2014.

Yes i'm 100% sure that i gave them everything, and the joint sponsor makes well over $100,000(gross) per yer, so it makes sense to think that there are looking at adjusted gross. And, RFE plainly says, get another joint sponsor because current doesn't have required income or show assets to cover the difference.

Ok. but there definitely has to be something that doesn't make your joint sponsor qualify to sponsor you. What about the household size?

The good news is my interview is scheduled for June 2. The icky news is my husband will be out of town for work, like other side of the country out of town.

Congratulations on your interview date ,not so good news with hubby being out of town?when did your status change to interview ready ? I've got a horrible feeling I'm going to get my interview date during the time me and my husband already have a planned and paid for trip :-/

I know, right? It just sucks. My status just changed yesterday (noticed this morning).

He's going to talk to his boss about rescheduling the trip before we do anything else. Here's what I've read on this forum:

  • Only military spouses whose wives or husbands are stationed overseas can attend the interview solo. If non-military attend solo, your green card will be denied and you'll be given 30 days to leave the country.
  • You can reschedule the appointment. The interview letter has a 1-800 number to call. The trouble is, USCIS doesn't always communicate the rescheduling with your local office and you can get dinged as a no-show. You'll have to start the process all over again and pay the fee again.
  • In a few cases, couples have scheduled an INFOPASS appointment with their local office, shown up with all the necessary documents and then been interviewed on the spot. This seems to be rare in its success.

My husband has already rescheduled this trip twice with his company, and this interview date is causing stress.

EDIT: I should note that I've also read vacation trips aren't acceptable reasons for USCIS to reschedule.

Wow can anyone confirm these things as being true ? If it doesn't state any of this on your interview letter I wouldn't believe it honestly :-/

Just realised I made a mistake on my EAD form... I wrote option A6 not C9.... man I feel so stupid. Breezed through the K1 and now I keep messing up my AOS! :crying:

Immigration Timeline

 

June 2013: Met whilst working at a summer camp in Michigan 

K1

November 1st 2014: I-129f submitted for K1 visa

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

ROC

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

N400

August 8th 2018: Window opens to submit naturalization application

August 13th 2018: N400 Application submitted online 

August 14th 2018: NOA1

September 6th 2018: Biometrics

February 6th 2019: Interview Date! APPROVED!

February 6th 2019: I was asked to return later the same day for my Oath Ceremony! :dance:

As I said, it's information gleaned from reading this forum. I tend not to discount people's real-life experiences. That's the purpose of VJ.com, to learn from other individuals' experiences.

I understand that and also understand everyone has different experiences but if that is all true it is pretty ridiculous in my opinion,they can't expect people to plan their daily routine around a green card interview that could be at any given time,you would think

I'm sorry to hear this. :( You could try and send them an updated I-765 and a letter explaining the mistake. Maybe it would catch up with your original papers and your EAD wouldn't get denied, It's worth a try.

That's a good suggestion :) I think I may send it with my RFE response.

LOL. Yeah, they can. They're USCIS.

I guess it depends on how you prioritize your life. Vacation > green card? Cool beans for you. Me? I'm gonna put green card just a tiny bit higher on the list than personal pleasure.

Well in my case it isn't a vacation it's my sister in law graduation and with my husband being military we kind of have to work around when we go anyway .best of luck
