Timeline

Our I 130 was approved on Monday. I haven't received the approval letter, but I had a few questions to ask the USCIS center.

I rung up and asked when the approved application would be sent to NVC for processing. She told me that since I was a US citizen, that when I get the approval notice, I should send it to my husband in London, and he should take it to the US Embassy and ask them what to do next. She said that they may requrie some additonal information, health check etc, but that since I am a US citizen, it wouldn't be forwarded to NVC at all. #######??? Everything that I have read, and I have read a lot, says the complete opposite of what she has told me. From what I understand, the app will be sent to NVC, then they will send out the support form to me. I need to pay and send it back, then they look it over again. They send a form to my husband asking which consulate the stuff should go to, then they have a nother look and then they send it on to the Embassy. Am I wrong? Is it as easy as she says?? I am so confused... :unsure:

Yes she is completely WRONG, what you have read is RIGHT, the people at USCIS have no clue what the immigration procedures are what so ever, your approved application does go to the NVC and yes you do pay the fee. Then it gets sent to the London Embassy, when it is sent to the Embassy they will send your husband package 3, this includes details on the medical and what he has to do to book it and what forms he has to send back to the Embassy including the police check, I would suggest your husband inquires about the police form asap that way he has all his ducks in a row.

Welcome to the rollercoaster ride of the inefficient and often ridiculous US Immigration process. Before even reading your post, my short, simple answer to your question was, "Yes, USCIS is giving wrong info". :)

After reading your question, my answer is still the same. It sounds like you have a VERY accurate view of the process. My case has just completed review by NVC, so I can vouch for what you have stated above.

Disclaimer: I am 99.9% sure that I am correct based on my own experience, and countless hours of research on VJ over the last year. However, I reserve the .1% right to be corrected by someone more knowledgeable on VJ who is more in tune with the facts of the above case... such as someone else filing a K-3 whose spouse is in the UK. :)
