I give up calling NVC anymore. I'm just not calling. It's not worth wasting my time. At this point, they won't even acknowledge what I'm saying to them. They simply keep repeating over and over 'Is there anything else I can help you with?' They aren't listening to a word I say, if they say ANYTHING other than that damn phrase it's to tell me that everyone I know who already has case complete is lying.

EP folks are literally 2-2.5 weeks BEHIND paper processing and it's not fair. I'm completely done with this. Knowing my luck, when they finally DO get around to reviewing my papers, I'll just get a checklist anyway. So done.

Met in 2010 on a forum for a mutual interest. Became friends.
2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

May 6, 2015: Interview at Montréal APPROVED!

May 11, 2015: Visa in hand! One year less one day from NOA1.

I totally understand. I've been bouncing all around thinking we will get a checklist, we won't, back to we will. There's no use in calling every day (I stopped that a while ago, doesn't help my anxiety or our case) and to be honest I don't see any point in calling until there's movement in our case somehow. An email or the 3 N/As or whatever.

I'm hopeful for you though, that since we know there was a 12/31 CC that yours will be coming soon. They seem to finally be moving, so maybe you'll hear something next week. (L)

OMG!!! I am soooo exhausted. That was a lot of driving!!

Dallas Field Office Review and a little extra background on my case.

I-601 waiver approved 1/6/2015. Contacted embassy for follow up interview. Was told our I-130 was in Administrative Review with USCIS. :shocked: We didn't know USCIS had our original petition.

Congressional inquiry to Embassy. Embassy says USCIS asked for the case back.

Congressional inquiry to USCIS. Colombo returned the case for revocation. Will issue a NOIR or reaffirm.

Congressional inquiry to Embassy. No we did not. USCIS asked for the case back so we returned it.

Urgh!!!!!!!!!!!!!! Argh!!!!!!!!!!!!!! :girlwerewolf2xn: I scheduled an info pass for today to clear up the discrepancies.

My number was called. The officer said the case was with USCIS. Of course it is. <_< It was returned by Embassy. I said please review the embassy emails, they said they returned at USCIS's request, not at their own. She said the email to USCIS said it will be revoked or affirmed. I said please read the emails from the embassy, they said they did not revoke my petition. She read the emails, then said she would need to pull my file. She was gone liked 20 minutes, came back and said an officer was looking at it, that she found my case, and she would come back once they are finished and she wanted to make copies of the emails I presented to her.

She came back and said, you are correct, the embassy did not revoke or deny your petition. :shocked: ?

I filed a writ of mandamus in July 2014 and since USICS's name was on it, they requested the original petition from the embassy to review the case to check and see if they had made mistakes on the case. Well, when it was returned to them, I guess it was stuck in a consular return stack. They never reviewed the petition. It just sat there. So the original reason for them requesting the petition was never carried out and the writ of mandamus has already been withdrawn. When the Congressional inquiry was made, the person just looked in the system, saw that USCIS had the petition and assumed it was a consular return for recommendation of revocation.

I asked, well, what is going to happen now? She said the officer will review my case to see if there is anything that needs to be addressed from the writ of mandamus, which there isn't. My writ of mandamus was because of the long AP my husband and I suffered through, I included USCIS because it was recommended to do so. The only thing about USCIS in the writ of manadmus was the NOA1, NOA2 and date when they sent my file to NVC. She said they will call me within a week if they can send the case back to the embassy. She said if they cannot and it requires further review, I will receive a notice in the mail.

Lesson I learned, 1st, the people answering the Congressional inquiries are not thorough. If they had actually looked at the file, physically, they would have seen it was not a consular return. The Immigration Officer said the embassy put a memo with my file that states USCIS requested that they return the original petition so they are returning at USCIS's request and not out of the embassy doing so. (This was very informational) Maybe there is hope.

2nd. When anything is returned from the consular, they are not even opened. They just sit until someone decides they want to look at the stack!!!! She said NO ONE had even looked at the package since it was returned to their office in 9/2014. :girlwerewolf2xn:

Even though I didn't get things solved right that second, it was worth the drive. I can breathe just a little although I am still quite impatient. I had all kinds of evidence with me. She said none of it was needed.

God have mercy and help us out of this quagmire.

I saw attorneys at the info pass too. They are limited to the amount of cases they can ask about, but they do it. You really have to stay on top of these people. It is sad we have to chase them when we are paying them to do a service.
