My interview is on April 15, my wife has filed her 2014 taxes already but what luck! Could have been on Apr 13 lol

I know this was meant, kind of as a joke, but do you or does anyone else know, if my husband's appointment is April 13, is he exempt from bringing 2014 taxes? I know I have been asking a lot of questions and apologize but my lawyer was paid in full up front so he tends to ignore my questions or gets cranky when I email them to him. The reason I am asking is for several years I have earned above the 125% of poverty level required for the AOS. We moved from Olathe, KS to Gladstone, MO in January of 2014 as I quite my job of almost 11 years and was looking for a whole new start. I had the ability to not start working until I found a job that I really wanted. So I took January and February off, getting the kids enrolled in schools (we have six) and getting the new house in order with the hubby (painting, unpacking, etc.). My current employment started 2/24/2014. I resumed a second job in 8/2014. My current salary and second job meet and exceed the requirements for AOS. I submitted previous tax returns, and about six months of pay stubs from my full time work, plus the stubs I had for my part time work. We never got a check list or denial for the AOS so I assumed it was approved. Now on the appointment letter it says to bring current year taxes. Because I didn't work January and most of February, and didn't start my second job until later in the year, my 1040 is short by about $700 for the AOS limits. Will they look at all pay stubs going forward from there as well? Or will my tax return hurt us? If they ask my husband if we have filed and he says no, he could be denied his VISA. I am thinking to send them with him, along with pay stubs and maybe a brief notarized statement as to why my income was lower on this return just in case they ask for it. I tried asking my lawyer and his assistant said oh they probably won't ask because its not the 15th. But then my lawyer chimed in and said if you don't think your current income is enough we need to do a co sponsor which will cost you another $500 from our office. My current income is not the worry. Like I said above I make more than enough it was just taking that time off that might have hurt us. Any thoughts?????

Tammy, they cannot require 2014 taxes on April 13th. If you are comfortably above the poverty line for your case for 2011, 2012, and 2013, they probably won't blink.

That being said, I would have your 2014 wage documentation and the explanation for the break in salary in your husband's back pocket, but, more importantly, arm him with your CURRENT (2015) paystubs. If asked, have him bring out the 2015 data first - a quick multiplication of your 2015 paystubs will show them that you are CURRENTLY above the line, and that should be good enough.

Tammy, they cannot require 2014 taxes on April 13th. If you are comfortably above the poverty line for your case for 2011, 2012, and 2013, they probably won't blink.

That being said, I would have your 2014 wage documentation and the explanation for the break in salary in your husband's back pocket, but, more importantly, arm him with your CURRENT (2015) paystubs. If asked, have him bring out the 2015 data first - a quick multiplication of your 2015 paystubs will show them that you are CURRENTLY above the line, and that should be good enough.

Thank you so much for your reply. I have lost a lot of sleep last night for this. I have printed and will continue to print until he leaves all of my pay stubs as evidence. I was thinking about putting the 2014 return and a statement in a separate stack, in case they ask so that I have pleaded my case and they understand. Or should I not send return at all and only earnings info?? What do you think? I am going to have explanation notarized so as to eliminate any issues arising later. Our letter actually says that all financial docs were sent to consulate from NVC and doesn't have a code to send more, but you know the standard letter says bring current year tax return. I am sure I am stressing over nothing but with this whole process being such a circus everything scares me. I would think if they had questions about my ability to meet guidelines I would have been asked for more info (i.e. a checklist) or even a requirement for a co sponsor before closing the case at the NVC, but who knows.

Tammy, if you have already filed 2014 taxes, then put your return and explanation in a separate envelope. Do not volunteer this information unless specifically asked. If the CO starts to question anything, then have your husband bring out the 2015 FIRST. If specifically asked for it, then your husband can bring out the 2014 stuff.

Hopefully all of this prep will not even be needed!!! Tell you husband not to volunteer ANYTHING - but have this info ready if asked or questioned.

Your last sentence is your best answer. If they had questions, they would have issued a checklist.

I'm just curious....after almost 5 years of marriage and 2 kids what can kind of question can they possibly ask?

Same as everyone else. It just depends how much they believe the CO's attitude or not. You could be asked 1 question or 20. I have seen it go both ways.

Since you are living together you won;t be asked for all the phone logs and emails and IM's and all that mess like the rest of us. So it should be very short and sweet.

Might ask the immigrate "why do you want to immigrate to US"?

I doubt for Japan you will have much issue with having to produce a DNA sample. Phew!! (no really Phew)
