I have a quick questions about the documents i (petitioner) need to send to the NVC.

1) I am a naturalized USC..do i have to send my birth certificate as well or just the birth certificate of the beneficiary(spouse)??

2)What do they mean by Evidence of Income??

3)Does/Will the NVC send any thing in the mail to my beneficiary in india that she may need to submit back to the NVC before her interview is scheduled??

1. Just birth certificate of your spouse

2. Evidence of income: employment verification letter from your employer with employer info/address, Salary details and your title OR 6 months of recent pay stubs

3. Only the petitioner will submit both AOS and IV package to NVC.

I am a naturalized USC. so do i need to submit my birth certificate to the NVC? thanks for any help!

No if your visa category is IR-1/CR-1

Hi Guys...

I seem to have come up onto another issue.we had our fiance visa denied at the Delhi embassy last year during with they took my original wife's notarized affidavit of birth which the embassy sent back to the USCIS who then never returned it to us.They say that it will take 6 months to get the documents back from them if we are willing to wait that long.In the meantime we got married and applied for the Spouse visa and now our file is at the NVC and we have to furnish an original notarized affidavit of birth again at time of the interview.We have an attested photocopy of the one the USCIS currently has in their possession.

So do we have to go and get another original or can we do something with the attested copy we have on hand?

I suggest you get new notarized affidavit of birth and take that to the interview

First of all they've lost marriage certificate. I wrote case number on every page of my case.

The second thing is when i filled aos i didnt put my 2013 income coz it was 0. I did put onl 2012 and 2010 only. For years 2013 and 2011 i included letters from IRS - verifiacation of nonfilling.

Also i included i-864a - my dad is the sponsor.

My question is - do i have to send them marriage certificate again or ask to find it and ask supervisor to review aos again. Because there is question that asks LAST tax return, my last was 2012.

But if i will send them package again do i need to include new i-864a from my dad?

Did u get a checklist email from NVC? If so, that would state what is missing and needs to be submitted.

Ask for supervisory review and in the mean time, send the marriage certificate also. that way, you are not losing time while waiting for supervisory review.

If they are just asking for marriage certificate, then just send them the marriage certificate...No need to send i-864a

I submitted the Aos and iv package today. We were unable to obtain my husbands police certificate from panama because you must appear in person, neither one of us can go there and he has no family there to get it. So i just documented that to nvc along with what i found online. A Record Policivo can be obtained from the Departamento de Autenticación y Legalización del Ministerio de Relaciones Exteriores. Applicants must apply in person or send a representative on their behalf with a photocopy of the applicants identification document or, in the case of foreigners, with a photocopy of the applicants passport. Applicants or their representatives must complete the form provided by the Departamento de Autenticación y Legalización del Ministerio de Relaciones Exteriores on the day of the request and present a photocopy of their passport or Cédula. The Departamento de Autenticación y Legalización del Ministerio de Relaciones Exteriores forwards the request to the Policía Técnica Judicial (PTJ). Fiscal stamps, purchased from Banco Nacional, to pay the processing fee and legalization fee should be provided at the time of document collection.

Apply in person or send a representative on your behalf with required documents and Fiscal stamps, purchased from Banco Nacional, to pay the processing fee.

Legalization fee should be provided at the time of document collection at

Departamento de Legalización y Autenticación del Ministerio de Relaciones Exteriores

Avenida Ricardo J. Alfaro, Edificio Plaza Edison Local # 15

Panama.

Hopefully this wont be a problem. Anyone had similar problem???

Has anyone on here used the EP process and can comment on if it seems better than mailing documents?

I submitted my documents through EP and so far the only big difference is the time it takes for the NVC to acknowledge that they have received your documents. I emailed my stuff on February 11 and just got an email 2 days ago to say that they were received (and from talking with others on here it seems pretty standard to wait about a month after emailing them). People who mail their documents seem to get that email a few days after the NVC receives them. It doesn't affect your scan date though thankfully. The email I got said that the NVC received my documents on Feb. 11 and to wait at least 60 days from that date so I'm just about half way. It saves you the cost of mailing as long as you have the patience to wait for the email!

My tax preparer filed my taxes single while am am married.

He is insisting there is no way I can file with my hubby because he did not live in the USA and did not work there, he also doesn't have a ssn and itn number so I cannot file with him.

Please what do I do and how do I handle this situation as I am due for interview soon please.

Will I be asked and what if I explain to them??

Any suggestions will be appreciated.

I saw some questions about this sometime ago but I never went thru and now I can't find exactly where it is.

Am desperatel pls anyone

You should not file "single" if you are married. You should file MFS or MFJ or if you qualify for HOH, then that would be an option but never single. You could have and are still able to apply for an ITIN for your Hubby. When is your interview? Maybe you can apply for ITIN and do an amendment prior to your interview.

Do not worry, you can file single now and amend your taxes when your husband gets here. You add kids if you have any. Remember, you amend your taxes 3 years back. IRS should be owing good chunk of dollars. Tell your husband to let CO know you are going to amend your taxes when husband gets to the US.

I filed my tax yesterday, I was advised to file as Married Filing Separately, the process getting ITIN seems long and you need your husband signing it also. I was told I can file amendment if I need to make changes. You want to do the amendment as MFS and take that for the interview. If your interview is before April 15, you should be fine presenting 2013 and letter from your employment, recent pay stub and 2014 W2. Somebody else might better ideas, see the respond and decide what to do. Good luck
