I think that that bill is to have our fees go to Treasury instead of USCIS. The issue I believe is that when there's an overage...when our fees add up to more than USCIS's operating budget, USCIS can keep it in a special fund that they can do with what they like. It was a big topic at the Senate hearing in February. Basically, they paid for a new building for DAPA (which is being held up in court). The Senators wanted to know where the money for an empty building for a program that's in questionable legal status came from....from this fund. Senator Cruz in particular was livid about that fact.

Ah, okay. I hadnt done a ton of research other than what it briefly says on the website.

Sorry to hear that, but if you got this point before the wedding, it's probably for the best. It's easier to break up before marrying than divorcing after marriage. I wish you the best of luck for the future.

Sarah89, you know this is such a long and stressful process. We have a bad days with my fiancee as well. And we broke up a few times:) just be strong, and think very very good, before making possibly wrong conclusions

You can contact them whenever. Whether or not they will be willing or able to help you now depends entirely on the caseworker your congressman has. The "official line" is that they can't open an inquiry on hour behalf unless you are outside USCIS's published processing times seen here:

Yes, that is as of April 30 and yes now it is 5 weeks later and no, USCIS doesn't care. That is, in my opinion, how they buy themselves extra time before people are allowed to open inquiries. So according to the official line, you're only allowed an inquiry if you applied before Oct 8. Some congressional staffers take this seriously, others are willing to try anyway (and are told the same thing by the person on the phone). Some may manage to get something done for you if you're not pre-Oct 8, most won't. Can't hurt to try.

My plan would be to wait until the 5 month mark and use that for leverage. Say that the goal time is 5 months, it's not your fault there's a backlog, you want to open an inquiry. See what they do.

If you got your copy in the mail, you're good (more than likely). Who know what happened with the other stuff. Either they forgot, or it came apart from your file. But the mail copy is the official copy.

Re: congressman. Yes. Every Member of Congress and Senator has an office in their home state that deals with constituent services--that is when someone who lives in their state or district has a problem with a Federal agency, their staff can make inquiries on their behalf. USCIS is a little different from most other agencies because they try to control when someone can and cannot open an inquiry with them. But as I stated earlier, some congressional staff will be more willing or able to "go to bat" for you even if it's not your "turn", and some just do their jobs better than others. For all we know, some congressional staff have been told to not help any immigration cases that aren't outside of the USCIS official timelines because the Congressman is famously anti-immigration.

It's a total crapshoot, just like everything else in this process. May as well try. Don't get your hopes up. You might just get the same canned response from them as you do from USCIS.

I used to have one of those jobs (it was interesting, to say the least)--working for a Congressman's constituent service office. Basically, all it is is a special phone number for the congressional staff to get to real people and ask questions. The "real people" are a small dedicated staff in a Federal agency that all they do is answer Congressional inquiries. But if the agency (in this case USCIS) has some canned, formulaic response or some hard and fast rule about timelines of who can and can't open an inquiry, there's not a whole lot those people can do, unless they're really willing or able to push, and even then....pushing may not help. But it still can't hurt to try.

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Haha I was just thinking the same thing last night!! This is stupid and the whole process makes me hate our Govt more and more each day. Specially when I live in an area where it's highly populated with illegals who don't speak our language and have 5+ kids and get Govt Checks. I'm over it... I see some Jan approvals coming through more and more - but yet I still think we have 2 more months to go and I fear I am going to get an RFE for something STUPID..

I just read that if someone has submitted emails where you refer to your other half as wifey or wife they will deny you - thinking you are already married. While I put future husband on some of my emails - he wrote once or twice wife - and I can't remember nor do I want to go through the packet to see if those are any I submitted. Which my luck they are -

I also think since he has two last names- the G325A is wrong where he wrote at the bottom one of his last names as his middle name.. I am going to have ulcers by the time this is done - who can I sue for that?

ahhhh it's getting exciting - 3 people with FEB NOA dates got their NOA2 yesterday according to the timetable- Let's pray this momentum keeps going and we start to see more and more each day.

It looks like the past week there were Dec- Jan approvals and only some Nov - I didn't any Oct though. But let's keep our fingers crossed. I would love to have a late Oct wedding if possible since it is my favorite time of the year. I know it is a long shot but one can dream right.. :-)

However I do find myself stressing out about a few little things here and there on my submission packet.

there are two from 2/4 and one from 2/2 - I am going by their timelines and NOA1 dates -

I received mine actual HARD COPY in the mail on 2/18 but the text came on 2/12 and in the USCIS website when I check my SRA number it shows a date 2/9 so I have no clue what date to go by. lol all I know is it is in FEB which seems to be coming around the corner for them to start processing...

Don't want to burst anyone's bubble but there haven't been any February approvals since last Wednesday. There were only 2 February's that day.

The good news is, TSC seems to be picking up the pace. They approved 92 yesterday, 72 on Friday, 63 on Thursday. Most of those approvals are January NOA1

If you haven't been to immifairy.com you should check it out. Their reports are very accurate and gives you a better since of TSC's progress (yes, CatherineA, I did just say that :) )
