Hello guys,

I want to know if anyone can help me in reporting a USCIS misconduct and irregularity.

I was advised by several ppl, not to take such n such step. they suggest to elicit sympathy from USCIS and don't make ur case bad etc etc.

However, untill this time, in working hard with them and doing anything they ask us to do.

But i didn't see any sympathy, but totally irregular responses so far, n now a threat to deny the cae?

so let see what u guys have an opinion and i will like to see if some one has an experience in doing it.

Let me make it clear, i m not expecting from CIS ombudsman to approve my case, but to ask for an independent review.

USCIS isn't an easy ride, and I'm sorry that you have endured such problems.

In your timeline, you state:

12/16/2005: Finally got the AOS interview date 29 DEC

12/29/2005: Asked for updated affidavit of support and vaccination document, not a single joint evidence to prove relationship is genuine.

1/18/2006: Sent both documents

1/21/2006: Another letter asking for 2005 income.

2/17/2006: Sent the new income recources.

3/3/2006: Intent to deny letter, not have provided evidence to prove bona fide relationship.

What information have you given as evidence that the relationship is genuine? What did you show at the interview? For example: joint bank account, lease/mortgage in both of your names, photos of you together and with family/friends, cards addressed to both of you, insurance policy with spouse listed as a beneficiary, mail that comes to both of you at the same address.

You might want to look through some of the other interviews that are posted on the boards and see what they included in their documentation? Was there a significant difference in what you brought in versus what others have brought in?

sorry for a msitake in my signature, i corrected it.

In interview, everything was fien and we answered every question they asked. The interviewing officer never demanded to see any evidence, we took with us.

He told my wife that he couldn't issue me green card today, as he needed updated financial papers and vaccination supplement. He never asked the updated affidavit of support in interview letter, either, but he insisted it only in interview no anyhting else.

However, the story of their misconduct doesn't start here, last year, in august i joint College to study in August 2005. i applied for financial aid. The college vice president contacted USCIS office in Louisville, KY to determine his case status to see if he is eligible for aid. He didn't get any aid, but the comments of college vice president on behalf of USCIS were "fiery". He told me, " USCIS people have deep a concern about you and you are a "national issue and suspect" and you are under suspicion due to your nationality, travel record, religion, and ethnic background. USCIS doesn't show discrimination but inside they do it and they are observing you closely". I was very disappointed with these remarks and the behavior of USCIS office. I want to know "Does the USCIS staff has the right to comment and discuss irrelevantly on his behalf to an unconcerned person?

The letter, they sent me on 3rd of this month about denial of case, was open and even not closed before dispatching., which upset us, as it could destrot our personal inforamation.

So these r few things, n so we r aggrevated by their hypocritic response. I have sent my documents now, but when i see their prejudice agenda, we get doscouraged and hopeless from these guys.

Man, that doesn't look easy. :(

First off, have you tried contacting your congressperson? It might be worthwhile to bring up that you feel as though you and your wife are being mistreated. It may be possible for you to ask the office of your congressperson for aid and whatnot.

Second, get a notarized statement from the vice president of the college if you mean to press forward. I think it would be a fair assessment that if you are contacted about any unfair situation, you should have as much information as you can.

Can you put together your evidence to prove your relationship? Make copies of everything and send it in -- though I would probably make a direct appointment through Infopass to find out whether or not it is "safe" to send. Or, do it in conjunction with your congressperson's assistance.

--> I also recommend that you get notarized letters from friends and family attesting to the validity/bona fide-ness of your relationship. People at the college (professors and the vice president) able to say you are joining the community and being active. This can go a long way if you have personal testimony and have sought to become an active person. <--

I will be the first to admit I don't know what all of your options are nor the specifics of your case. However, talk to those in higher places if you can and find out what options are available to you. If you feel very much under threat, find a skilled immigration attorney that is familiar with handling cases like yours and ask for a consultation.

The general consensus on VJ is that the ombudsman is a waste of time. I have never read a single story where they helped.

I don't see where it will hurt anything to complain at all levels but don't expect to accomplish anything.

Your Senator or Congressman will probably be more helpful, but still don't expect magic from these people. After Sept 11 the DHS became the most powerful and irresponsible organization in the world. If anybody complains they use the " national security " to scare the world.

I think the best approach would be to find an attorney to pursue the Green card - forget about the harrasment/discrimination angle at this point. After you get done with the Green card - then you can file a complain through whatever channel you want to with as much proof as you have or as joe has mentioned don't worry about that angle as it is more troublesome than worth. Good Luck and yes our sympathies are with you but I think you need to go after the right thing - the Green card - going after the complaint etc. is more heartache and not worth it. Best wishes

I think u guys suggestion make sense. I am concentrating on the GC issue and hope that after sending pretty ample evidences, they will give me a ggod response. One thing, which i saw is that the immigrants are suffering in both case, it s their fault or USCIS fault, only thy suffer n their cases get affected.

What worries me that like i saw a glimp in my case, they don't know what they asked for or what s goin on in case, they just throw it on u.

What looks to me is like they r sovereign lords, n they care for no one, if they r suffering.

N i think that the only ppl r suffering with USCIS r ppl whose cases r genuine, the ppl who have bogus cases, they know already how to do it.

They pay big bucks and hire good attornies and make all papers, they need.

But ppl like us who have everything fine and fighting their cases their own. USCIS don't believe in them.

I already contacted our congressman and the woman in his took our data and she told us that i will be in touch soon.

We are also planning to send a letter to senator and get some assistance.

At least that USCIS get an idea that we care n r serious.

Don't take this so personally. These folks are idiots. The same deprtment that handles immigration handles national disasters ( hurricanes ) and all American security. They really don't have the time or intelligence to discriminate.

Let's face it! You are from Pakistan. Your governement has been very helpful to us in the search for Osama but the general population is in disagreement with your government. You should expect and accept a little extra questioning.

Be nice, play their game, and you will get the card. It is unfortunate that things are this way but Islamic extremists have caused serious damage to America. If you come from a country that has many Islamic extremists then you can expect to be put under a microscope.

We love you and we want you to stay here but you have to accept a little extra security.

Thanks for ur comments, i think that everyone understands the situation of security and etc.

I never objected on "extra questioning" sir and amazing thing is that they haven't. Because they never found problem with my background check, or name check or any other matching.

We appeared for interview and i was never asked about this garbage, as they r not kids sitting there n they don't know about me. If USCIS officer or some one can talk this bullshit to an unconcerened person on my behalf and while sitting before me are smiling n showing no problem?

Then, ask for papers, which they never mentioned, if they were having problem in bona fide relationship, why the immigration officer didn't feel any need to ask for it and confirm it in interview.

What s happening in Pakistan or elsewhere s political game.

If u think that USA is the champion of equality, justice and law for everyone and as i was told that we judge ppl on basis of their their personal character, Then my expectation, not to be made as an "escape goat" is right, right?

i really dont think they are making u a scape goat or targeting you specifically... as said before send in the papers requested.. and accept whatever decision is made in the end. if it is a negative decision there are ways and means of reapplying or asking for a hearing etc...
