I got an update - as of today my case is inline for Interview - Thank God the Background check is done its a horrible waiting Game.

all of you guys who are stuck with Background check would suggest contacting your state senator - I contacted the senator here in Washington and in about 2 weeks surprisingly the background check was all clear or maybe its a coincidence.

Excellent recommendation.

Although, I'd recommend a service request and contacting the USCIS ombudsman as earlier steps before this. Different tactics seem to work for different people.

It's not a coincidence.

If you read through all the monthly threads there are too many cases of people being placed inline 2 or 3 days after a service request or 5 days or a week after contacting a representative. People say it's just a coincidence and I would agree if we were talking about one or two cases but there are way too many. When you've been waiting for 12 months then contact your senator and you're suddenly placed inline within a week, it's hard to think the two things are unrelated.

I think there's a big chance that the background check was completed months ago, but that USCIS is just incredibly inefficient at updating cases. So when a service request is started or when they get an inquiry from a senator or a congressman, they check and realize that the case is ready for an interview. So it's not that these actions are speeding up the background check; it's just that they're forcing USCIS to look at your case. Just my theory.

Just a coincidence ! Cases are stuck due to background checks and that is not in the hands of USCIS . Having said that it's good idea to contact your representative to let them know the performance of USCIS and get another formal answer from USCIS.

Hard to say definitely, but there are probably 20 such cases in the last year or so just here on VJ... cases where a service request or contacting someone triggered an Inline notice within days and after months of waiting.

Sometimes these requests don't work, because the background check isn't done, but they do work too many times to think its a coincidence. As I said, my theory is that the FBI completes a prolonged the background check within a few weeks or maybe months of biometrics but that uscis isn't efficient at checking to see if the checks are completed. Maybe the process just isn't automated. And so your application just sits there until a service request or an email from a congressman forces someone to look at the reason for the delay and they realize that you could have been placed in line months earlier. I don't think this happens to many people; I think that if your checks are done within a week or two, as is the norm, you'll be placed inline pretty quickly.

That's my opinion of the issue. I suspect that without contacting anyone, you would have been placed inline eventually, but only when someone looked at your case... it could have been months from now.

Of course I could be wrong and all those cases could be coincidences, but if so, I'd like to start betting money on whether or not such action will move a case forward after 7 or 8 months.... it doesn't work for everyone, but the odds seem to be pretty good.

That's very frustrating.

You say 10 months, but if you filed in March 2015, it's been a year now.

Have you contacted USCIS yourself or through your political representatives?

Going through a congressman or a senator doesn't always get you a different response, but sometimes it works. I'm not really sure why; maybe they contact the FBI to see what the hold up is or maybe USCIS does that when they get an inquiry from someone important. I don't really know. As someone said before, I don't think this will speed things up if they are waiting on information needed to complete your background check, but just based on cases reported on here and on cases reported on in the media, there are many cases where a background check is just stuck for no reason without anyone working on it.

So if you haven't contacted your representatives, I would do that now. If that doesn't work (or if you've already tried) then you should consider getting a lawyer. That, again, is just my opinion, but based on what they've told you, the background check will take as long as it takes, even if that means years. That is not acceptable.

Having said that, sometimes inquiries trigger action, and even though you got that useless response, you may see action on your case in the next few weeks. So I would advise you to plan your next steps, but keep an eye on your status. I hope it gets updated soon. Good luck to you.

before a month they say my case on background check and now they say in still in NBC

This may actually be correct. Usually, but not always, NBC won't sent your case to the local office until the background check is done.

That's what seems to happen in most cases, but sometimes applicants show up for an interview and are told their case is still at NBC. Or sometimes the file is at the field office and the background check isn't done. It's not very consistent. I hope you see some progress soon.
