K3 Need Approved I-130 Before Applying for AOS?

Hi Everyone:

Does anyone know if it is necessary to have an approved I-130 before a K3 can apply for AOS? I have already moved to the U.S. but my I-130 has been sitting untouched in VSC since July 2006, and I'm beginning to think it has been misplaced. I see people with approvals from submissions in September and October while mine doesn't even register a 'touch'.

Also, if I can't apply for AOS can I send an EAD application alone without the AOS? Mine concern here is I read another post that said an EAD is only given a 90 day priority if it is based on a pending AOS, and if filed alone the EAD is treated whenever they feel like getting to it.

You definitely can apply for an EAD alone (as a K3) It will be vaild for as long as your K3 is valid.

I am not 100% on applying to AOS without an approved I-30....i believe you can....I will leave that for someone more knowledgable!!

11/16/06 Transferred to CSC

11/17/06 Biometrics appt

11/27/06 Touched "Case now pending at CSC"

1/12/07 EAD "touched"

1/16/07 EAD "touched"

1/17/07 EAD approved "Card production Ordered"

1/20/07 I 485 "touched"

1/22/07 EAD card received

6/13/07 Transferred back to Missouri....grrrrrrr

7/23/07 Interview date! FINALLY!

7/23/07 AOS APPROVED!!! :o) 10 yr Greencard I 551 stamp in passport.

7/28/07 Welcome letter received

7/28/07 Card production ordered.

8/1/07 Approval notice senT

8/3/07 Greencards received in mail!
