I am a US citizen. I met and engaged a Filipino girl while living in China. I am about to return to the United States in less than a week. First of all I am concerned about what I need her to accomplish for the process, because I want to get that done before I leave. I know I need the passport photos, and the G - 325. Anything else?

Here is the big question though. I am going back to the states to a new decent job. But as far as my financial situation, there NO way I will qualify once they look at my assets or lack there of and credit history. So I will definetly need a co-sponsor. So when/how do I go about getting a co-sponsor? Can that co-sponsor live in China? (my father lives in China).

I would appreciate any help you can give me.

In addition to the G325, she will also have to sign a letter of intent. I strongly suggest viewing the FAQ and sample forms section of this site. Almost everything you need to know is there. Good luck. That will cover the initial part of the process. Also if she has any divorce decrees or anything like that, you will need the paperwork (translated).

Not sure how to address the co-sponsor situation........

Not sure about the co-sponsor issue, but the USCIS doesn't look at your credit history, just your income.

At what point does income become an issue? Because I do not see anything on the I 129F or the G -325. If it is later, there is a chance I can get back on my feet a little bit.

Basically, I am thinking at what point in the process does finances become an issue? Because I am sure at that point, I will need a co-sponser.

It's later in the process after your petition reaches the embassy.....I-134 document. Depends on the service center and situation but it could be a couple of months after the NOA2.

You will need to fill out a afvidavit of support and your Fiance will need to bring to the interview. You will need to have it with your last 3 yrs of income tax returns.

so it will become a issue in a few months..

ok, that is painfully helpful...assuming those reports are dismal...I hope that I will be able to provide a co-sponser at that point...otherwise, I will have to wait for a rejection and then do the co-sponser...

General Outline of I-134 Requirements

A good reference for Overcoming the Public Charge

While an applicant for a fiancé(e) visa is not required to file an affidavit of support (I-134), it is nevertheless useful in proving the applicant is not likely to become a public charge. The Immigration and Nationality Act does require the applicant to establish to the satisfaction of the consular officer at the time of the application for a visa, and also to the satisfaction of an officer of the Department of Homeland Security, United States Citizenship and Immigration Services (USCIS) at the time of application for admission to the United States, that he or she is not likely at any time to become a public charge.

9 FAM 40.41 N4.6-3 Use of Form I-134, Affidavit of

Support Under INA 213A

c. The simple submission of Form I-134, Affidavit of Support, however, is

not sufficient to establish that the beneficiary is not likely to become a

public charge. Although the income requirements of Form I-864, Affidavit

of Support Under Section 213A of the Act, do not apply in such cases

(i.e., the 125 percent minimum income, the need for three years income

tax returns), consular officers must make a thorough evaluation of other

factors, such as:

(1) The sponsor's motives in submitting the affidavit;

(2) The sponsor's relationship to the applicant, (e.g., relative by blood

or marriage, former employer or employee, schoolmates, or

business associates);

(3) The length of time the sponsor and applicant have known each

other;

(4) The sponsor's financial resources; and

(5) Other responsibilities of the sponsor.

NOTE: When there are compelling or forceful ties between the applicant

and the sponsor, such as a close family relationship or friendship of long

standing, the affidavit may be favorably considered by the consular officer.

On the other hand, an affidavit submitted by a casual friend or distant

relative who has little or no personal knowledge of the applicant has more

limited value. If the sponsor is not a U.S. citizen or lawful permanent

resident (LPR), the likelihood of the sponsor's support of an immigrant visa

applicant until the applicant can become self-supporting is a particularly

important consideration.

As far as I know the cosponsor must be a US citizen and I'm assuming live in the US. If I'm wrong someone correct me (I'm sure Yodrak will have a reply! :P:))
