I didn't see this using the search and if it's been posted before I apologize.

Let's say for the sake of argument that the following is true:

2004 - income is $15,000

2005 - income is $30,000

2006 - income is $15,000 (due to layoff)

2007 - income is about $2,500 per month since November 2006 (and expected to continue)

Now, if I was filing for a stepchild and this made my family size to be 4 members the qualifying income (125% of poverty) is currently $25,000.

Will this cause issues with the I-864 due to variance in past years (2004 I was single, thus, not needing much income; 2006 income was lower due to layoff)? Or will they only be concerned with the current ability to earn enough to pass the income threshold (meaning if all of 2007 passes I will make about $30,000)? And does the EIC count as part of the income requirement (i.e. if we qualified for $3,000 EIC would that be added to the 2006 income to make it $18,000?)

Let's try this a different way:

If I'm applying for a visa this year would the USCIS be more concerned that my income will exceed $25,000 (family size of 4 including the beneficiary) than the fact that it didn't last year (when I wasn't considering applying for a visa).

Does anyone have experience with this? What I'm reading online from some immigration lawyers:

....suggests that the I-864 would be accepted if this year's income will meet or exceed $25,000. Yes? No? Thanks.
