Good Afternoon VJ,

I am Canadian and in August of 2014 I married an American, I just called USCIS and asked what forms I needed and this is a list of what she said I needed

I-485 $1070

I-130 $420

I-693 Medical

I-864

I-765

I-131

G-325A (2) One for myself and one for my husband

Here is the kicker, she told me to get all the forms and read the instructions and put everything all in one envelope and mail to the Chicago Office, my question is, are these forms fillable by myself or my husband or do we need someone to fill them in for us, and is it normal to send everything at once?

ok I have hit a rough spot, I am doing out the I-130 I am at section C where it asks to list Information about your relative, does my husband put my name in there and do I have to put my children who have grown and have family's of their own on there, I am asking this because when I look at the completed form on here it shows the husband name listed but he is the petitioner, :cry: so confused .

I am not sure what I am doing , this is what was told to me by USCIS , to download these forms and fill them out and send in the required fees and everything to Chicago

The question that was posed by a previous poster is are you currently inside the US? If so, the the process you are about to embark on is Adjustment of Status.

If you are not currently inside the US, then you will be emarking on the Spousal Visa process.

Please clarify so this thread can be placed in the proper forum. The USCIS phone line is known for not always giving out accurate information (hence the reason why its commonly referred to as the misinformation line on VJ).

I believe after reading some other posts, I only have to fill out the I-485 , I am in the United states therefore I don't have to file the I-130 ?

This is only the case if you entered the US on a K1 visa and married within 90 days of entering on that visa. If that does not apply to you, then you have to file both forms together (I-130 and I-485).

Hey

I am exactly in the same position - I am canadian and married my husband in Canada in August 2014. My husband filed the I-130 and I325A (2) and I864 and posted to the chicago lock box.

we got confirmation within a month that it got accepted. So basically as he is petitioning for you to go there....he files it and then we wait until NVC pass it to the local consulate for the next stage which is basically collating the information and thats when you start putting the info together.

Once you get receipt of the I-130 we actually concurrently filed the I-129 as well (which doesn't cost anything if you filed I-130) as a non-immirhant status - so allows you to enter US and stay with your husband whilst the visa is going on - - depending on which goes through faster if one is accepted then he other is cancelled...hope that makes sense?!

In the meantime - I have started to gather all the information that needs to be sent as proof of relationship etc and certificates required - making sure my vaccinations are all up to date etc before the medical.

I am now waiting for the NVC to transfer the case to the consulate here in Canada.

Aug 25th 2014: Got Married in Canada

Dec 15th 2014: I-130 Filed with Chicago Lockbox

Dec 18th 2014: Packaged received by USCIS
Dec 22nd 2014: Received NOA 1
Jan 14th 2015: Received NOA 2. Case APPROVED with no RFEs
Feb 20th 2015: Case # Assigned by NVC (will be going to Montreal for Interview)

OP is adjusting status, the NVC and filing an I-129F (I-129 is filed by employers for non-immigrant employees) is not relevant to their case.
