Immigration Delays Likely as DOJ Weighs Legal Options

Some immigrants already have expressed concerns about revealing themselves to immigration authorities. If the outcome of the presidential election is unclear or it appears the new administration might scuttle or change the program, more individuals could be deterred from applying.

Virtue said he doubts either the 5th Circuit or the Supreme Court would issue a stay to allow Obama to expand a program or start a new one.

“I just don’t see either court granting a stay. A stay is typically granted to have the status quo maintained,” the former immigration official said. “Legally, I don’t think they have much of a basis for seeking a stay……Trying to get the thing expedited [at the 5th Circuit] is the better approach.”

Still, there’s no guarantee the 5th Circuit will expedite the case. One expert who closely tracks federal appeals courts says even an expedited case in that circuit will likely take several months to resolve.

“That court hasn’t been particularly quick,” said University of Richmond law professor Carl Tobias. “The same-sex marriage appeal took almost 11 months to get argument scheduled….They can expedite it but it’s going to take at least three to six months. I would expect they would grant [expedited treatment,] but it doesn’t mean it will be that fast.”

Looks like Congress has the time to work its will. The question is, will they work their will, or will they punt and let the courts decide this one?
