according to my lawyer, she's never seen them not take a co-sponsor... with that said, our 2nd interview is hopefully coming soon...... (case put on hold for evidence of financial support) and we're using a co-sponsor..... so let's hope my lawyer is correct

IF she has never seen them take a co sponsor then she is an idiot.

I have seen them take them. My mother acutally sponsored my nephew a few years ago in Philippines......

Hello!

Thank you so much for taking the time to reply. I found your post very interesting that's why I ended up asking a bunch of questions.

May I just ask you, considering our situation, would it be ideal to file for the i-129 now using a co sponsor? I know its case to case basis here in USEM but I dont know if we should risk it or not. It makes me sad that him getting his chance at fulfilling his dream of finishing school would bring some problems with the petition itself.

Thank you by the way for giving me ideas about what to tell the CO in case they ask me why he is unemployed. He has zero time to go to work because of being a full time student. And if even he goes to find a part time job this summer i'm pretty sure it would not be enough to meet the set poverty guidelines. I am hoping for the best here but it's very hard when you dont know how to move forward.

Anyways, thank you for your time and any other ideas would be great as well. :)

It's up to you guys if you would want to file your i129 right niw. I cannot say which way your case will go. But i dont see why a CO would deny your case. It just all comes down to the CO. You can just file a i129 again if denied, but you would have to pay the fees again.

Chinook and I know a young Pinoy K-1 couple here in the U.S. who did not need a co-sponsor despite the fact that the petitioner had no money, had never held a job, lived with her parents, and was in nursing school.

The Filipino prescreener told the beneficiary that the U.S. Embassy Manila does not accept co-sponsors in K-1 cases. However, the consular officer approved the visa without even asking to see their co-sponsor's papers.

No problem. The petitioner's parents co-sponsored the beneficiary.

Now they are living happily ever after. They are both working and they had their first child a couple of weeks ago.

thank you! I guess we'll try to go ahead and file it this June. I just hope it goes as well as yours did. And my fiance told me that he'll just take a few classes this fall then look for a part time job as well as go to school. A friend I made here in VJ advised me to go and try the CO sponsorship route as well but just present those docs when otherwise asked by the CO.

ahhh these lawyers... my fiance went to one and advised him to secure a job while on the process of applying for the 1-129.

There's no harm in trying I guess. But I've noticed that they provide different information to different clients. Don't know why that is though. LOL

Many people have posted here on visajourney that the CO did not accept them having a cosponsor. It is really a case by case basis.

And in the end for us the CO did not ask for our affidavit of support. We are now in the process of filing for my husbands AOS

ohhhh that's awesome! I've read some of the people here on VJ had the same experience as you guys did.

Same with us. We just graduated and they didnt ask for the cosponsors paperwork.

It was about a year and a half ago...or so.

At that time, it was very unusual. The consular officers usually required the petitioners to have an income exceeding 125% of the poverty guidelines based upon household size. Accepting a co-sponsor was hit or miss. Not asking for any financial papers at all was rare.

Me and my wife (NOW) both graduated from the same school (nursing) 2012. I filled for I-129 here in the states 1 year after graduation (2013). Got approved went through all the stages. Until the interview we got denied June 2013 because i wasn't working (NCLEX review & exam) and tried to use my mom as a co sponser and still got denied. The lady at the interview said "I am sorry. We can't take co sponsers and asked if i had filed for taxes that year." She was very nice but said they didn't accept co sponsers I had everything but a job that is around 20,000. My mom makes 6 figures and has like 300k in assests well above the 125% federal poverty line. So i said screw it went back to Philippines and married. If you want to gamble you can file I-129. If you want the sure thing File I-130 as they accept co sponsers without question. It has been a long journey. Hope this helps future people on the same journey.

Thank you for your input! This was suggested to me as well a few weeks back. We will definitely look into this as an option as well. Everything really is a case to case basis sort of thing it seems, but I guess it would definitely be better to be well prepared for it. I appreciate your input and my fiance and I will talk about this and other options as well.

Good day to all!

I just wanted to ask for update if its ok? I am in the same situation also. I am graduating in May and will go back to Hawaii after, I want to petition my long time gf. I have been prepping all requirements and all of a sudden I read that Manila Embassy does not allow co-sponsorship. :(
