Hi all! I just wanted to get advice on what you guys think will be the probability my fiance's visa will be approved or denied. We have already surpassed everything the next step just being our interview. I am the petitioner. Me and my fiance recently graduated with our Bachelor's in the Philippines last May. I got pregnant at the end of July so once i came back here to the United States i was not able to get a job right away. We are using my mom as our co sponsor who makes almost 4x more than the requirements or above the poverty line. I hear that using a co sponsor in the K1 process is often denied, but I hear it also depends on our case. Does the fact that we are new graduates and I am already 7 and a half months pregnant give us a better chance of accepting my mom as our co sponsor? I did not know of filing to apply for a K1 visa would give us a hard time in terms of using a co sponsor ahead of time. What do you guys think?

I have seen the CO allow a fresh BSN graduate from Philippines get an approval before, and petitioner had zero income.

It is all based upon the CO

Latest reports from previous K1 interviews is they are not requiring I-134 AOS documents

Yes we both graduated Bachelor's in Radiologic Technology. Thank you for giving me confidence! I've been thinking about it nonstop since reading about other's experiences. I really hope they look into our circumstances if they do look into our affidavit of support.

You are on the plus side by using your mother as a co-sponsor as having a close relative as the co-sponsor is something the embassy requires with the K-1 IF they are going to consider a co-sponsor at all. Your being pregnant has zero bearing on anything. Being recent graduates from college may not have a bearing either, but I have seen the CO smile upon recent graduates.

With all that said, the embassy has revised the instructions letter and for many have not been asking for Evidence of Support at all. You now have the possibility of not even being asked for support documents and being approved.

Hi congratulations on your coming baby, I think co-sponsor is Ok but as far as I know in Affidavit of Support you need to have a current job or income.

Not true. If the embassy is willing to accept a qualified co-sponsor that is all that is needed.

My fiancee just graduated this Dec 2014 and I was interviewed last Feb 2015. I passed interview and got my visa with no problems. CO didnt even asked for a my fiance's AOS nor a co-sponsor. The thing though is you guys have a baby so AOS MAYBE asked..Goodluck!

Congratulations on the wedding and the baby!

I was just wondering what sort of documents my USC fiance would need if he is currently a student and has been out of work since July 2013, he has been working for 8 years in the US but decided to go back to school. We are planning on filing the I129 before he goes back here in the Phils this July. (He's Filipino as well). LOL . I am very worried about the AOS because he does not have any recent pay stubs or ITR's. Although he has assets (own house, own car, 2 bank accounts) and are planning on using them instead. Co sponsorship from his step dad who is well above the poverty guidelines is one of our options as well.

That being said, I have a few questions:

1.)Would his current unemployment and status as a college student affect our chances of the visa being approved?

2.)And would it also be a good idea to mention to the CO during the interview (if the i129 gets approved) that he is currently a full time student which is why he is unemployed at the moment?

3.) Would his assets suffice as his AOS? I'm still not sure about the co sponsorship issue here in USEM. But his step dad is very willing to share sponsorship. :(

I saw your post and it was very encouraging and enlightening as well. I apologize if I am posting this as a reply not as a totally different topic/thread altogether. I'd appreciate any response. Cheers and Mabuhay! as we say. :luv::sleepy:

They didnt ask for any of my documents surprisingly from my fiancé. I would say be ready to have to affidavit of support documents ready that he has filled out and his step dads affidavit of support and all the supporting documents needed to show proof. My mother was our cosponsor and I had him bring my mothers bank statement from the bank and a letter from her job. We didn't need any of these, however, because they never asked for it. I would bring the proof of him owning his own house and car and a letter from his bank as well.

I don't think it would affect your chances of being approved since he is unemployed and a student. For us they didn't even question it. Just be ready to explain that he is a student and his story in case you guys get a strict CO. They say it really depends. In case you see the interview going a little negative because he is unemployed i would say start explaining that he is a full time student and with that he has a lot of potential when he graduates to get a good paying job.

I have no idea if his assets would be ok for the AOS but you can just use his stepdad for support. Just have him also fill up the AOS and bring the supporting documents.

Thank you so much for taking the time to reply. I found your post very interesting that's why I ended up asking a bunch of questions.

May I just ask you, considering our situation, would it be ideal to file for the i-129 now using a co sponsor? I know its case to case basis here in USEM but I dont know if we should risk it or not. It makes me sad that him getting his chance at fulfilling his dream of finishing school would bring some problems with the petition itself.

Thank you by the way for giving me ideas about what to tell the CO in case they ask me why he is unemployed. He has zero time to go to work because of being a full time student. And if even he goes to find a part time job this summer i'm pretty sure it would not be enough to meet the set poverty guidelines. I am hoping for the best here but it's very hard when you dont know how to move forward.

Anyways, thank you for your time and any other ideas would be great as well. :)

according to my lawyer, she's never seen them not take a co-sponsor... with that said, our 2nd interview is hopefully coming soon...... (case put on hold for evidence of financial support) and we're using a co-sponsor..... so let's hope my lawyer is correct

Many people have posted here on visajourney that the CO did not accept them having a cosponsor. It is really a case by case basis.

And in the end for us the CO did not ask for our affidavit of support. We are now in the process of filing for my husbands AOS
