good evening guys..

here's a thing

i am an k1 visa holder and i just got married today.. and i am preparing now for sending the AOS. but i have questions that i cant find answers on the internet..

so, getting married doesn't mean that my surname is automatically changed right? because we are planning to have a church wedding when my husband is already finish studying where my family and his are included to the ceremony.

the papers require Alien number. the problem is, i don't know what my Anumber is and i cant find it.. do you have any idea where to find it guys?

i dont know what to check in G-325A. Naturalization or Status as permanent resident?

when i have my seminsar in CFO, the woman told us to contact them after we get married (so i did) also she told us to contact USCIS. how will I contact USCIS??

and lastly, i want to send an application for travel document. do i have to fill up the questions where i have to indicate the country and the date of my visitation though i will not travel right away??

thank you guys for the clarification..

Hi,

FIrst of all, congratulations on your marriage!

To answer your doubts,

a) Your name or surname will not change unless you file for an official name change

b) Your A number is written on the NOA2 that you had received during the K1 visa process, it would also be printed on the K1 visa in your passport

c) You check status as permanent resident because that is what you are applying for. Naturalisation means citizenship

d) I'm not sure what you meant but maybe she meant sending in your AOS application to USCIS as soon as you get married. That's what they told me during mine

e) You can write a tentative date when you have a possibility of travelling. Doesn't have to be exact dates

Congrats!

You are married so yes you can use your new surname now on all your forms, there is a place for your maiden name on them. However, this is what my wife and I have had to deal with.

You shouldn't waste your time getting your name on your Social Security card changed until you have your Green Card in hand. They will just make you go in again and provide them the GC before they will do it. - asinine policy.

Just get your EAD, if you are applying for it, in your maiden name so it matches your SS card. If you get a job before your GC arrives they have to use the name as it shows on your SS card.

1. When you fill out your AOS paperwork, use the name you want after your marriage. If you follow Filipino naming standards, that would be your first name, former last name, husband's last name. That way your EAD/AP card will be in your name after marriage, and in the future your green card. Once you get your EAD/AP with your new married name, you will just go to the SSA office and get your name changed on the SSN card. Simple as that.

2. The A# is listed on the NOA2 from the I-129F petition.

3. You are filing as a permanent resident.

4. CFO wants to call you because it's a survey. They want to see how you are doing. Trust me, if you don't call them, they WILL call you. I thought it was crazy when my wife said that CFO would call her in the US, but they did.

5. No reason is needed when filing for AP. You can write UNKNOWN for dates of travel and length of stay.

This is not entirely correct. The marriage certificate serves as a name change document. Some states do not allow you to change your name on the marriage certificate directly, but you can go to the SSA office with the marriage certificate and get your name legally changed that way. Once your name is changed with the SSA, you can change the rest of your identity documents accordingly.

You can't just start using your husband's surname and it doesn't become "your new surname" unless you have officially got a name change.

Yes you can. The marriage certificate is your official document of name change.

That's what I meant by an official name change. You have to get it changed with the SSA before you start officially using it.

You can also change it on your immigration paperwork as well, without even going to the SSA office. Yes you need to change your name with the SSA office as well eventually, but you can do that again when you get your EAD (which would be in your married name).

The same reasons you are allowed to change your name with the SSA will allow you to change your name on your immigration documents. You do not need to change your name with the SSA first.

Yes. That was the whole point. The question was if they can just start using their husband's surname everywhere after getting married. My answer is still no. You cannot automatically start using your husband's surname after a marriage certificate. I got married few months back too, but I can't just use my husband's surname because I did not get my name changed. Either at SSA or in the AOS application and then at SSA, either way it has to be changed first.

To a point I agree with you. But it doesn't have to be changed first for everything. For most things maybe. For some things, such as being added to insurance, you can use the married name.

When I added my wife as a dependent on my insurance, I used her married name...even though her name on the SSN card was still in her maiden name. We didn't change her name with the SSA until she had her EAD card. She was added to my insurance the first part of September, her name wasn't changed with SSA until December. No problems at all.

That's great that it worked out for you. I'm not sure about insurance, maybe it worked because in insurance you just add the person's name for now. It doesn't require the person's IDs or documents until the insurance is being applied for. That's when the name would be matched with the ID containing the new name.

You're spreading complete nonsense. There is no official name chance, once you get married you can just start using it. All it's needed is marriage certificate. My wife did not "official name chance", just started using it. Didn't have to opt for anything.
