I have a question about the I-765 form. Actually two questions, first, do I need one? My wife already had a SSN from when she was here on a J1 visa. When we went to the SS office to change her name, they told me she was legal to work already. Were they wrong and I still need to submit this form?

Second, on the I-765 form, it asks if you have ever applied for employment authorization before from USCIS. Is the J1 visa from the USCIS? If so, how do we know which office it was from?

Um, did you come here on a K1 visa since she was a j1? I too was a j1 and had a ssn from that but my j1 expired long ago, so I had to apply for the I-765 because I can't legally work here again without this kind of proof. Just because she has her SSN doesn't mean that she can just work. She must have some immigration doc making it ok for her to work. To change her SSN name just bring in your current visa and passport and marriage certificate and they should change it - as long as you are still in status.

Oh, sorry I didn't look at your heading that you did DCF. If her J1 has expired, which it does have an expiration date, then she can't work until she gets another immigration (I-765 or greencard) document to prove she can.

May 7/07 Greencard is in my hands!

ROC Journey:

February 17/09 Sent I-751 to CSC

February 18/09 NOA1

March 14/09 Biometrics appt.

April 22/09 Date of Approval!!

June 25/09 Greencard arrives in the mail!

That is what I thought, I just wanted to make sure. We were thrown off when the SS office told us that she was legal to work according to their records. Her J1 is expired, she is now here on the k1 and we already have been married.

I am still wondering about how to answer the question about having applied to work through uscis before. She got her J1 visa in Guayaquil, Ecuador and worked in Ocean City Maryland for a summer. The question on the I-765 form asks which office she applied through and whether it was granted or denied and proof of that. We have the passport wit the expired j1 on it, is that what they want? I guess my real question is if the j1 was through uscis and how do we know which office it was acquired through?
