Multiple filer for K-1 petition question

Timeline

My fiance had her ex boyfriend file a K-1/I-129F petition for her to come to the USA. It was approved, but then they broke up. She and I started dating last year, and I also filed a K-1/I-129F petition on her behalf. I received a letter from the USCIS for an RFE (Request for Evidence) asking for a multiple filer waiver. Since the rules stipulate that you only need a waiver if you, the petitioner, have filed multiple I-129F petitions. But this is my first petition for her. What do I need to do? Thoughts?

Send them a letter stating the same. They are confused and you have the onus to set them straight.

On other hand, is this the first K-1 filing for you, have you ever in the past filed for a K-1 for someone else? If so, then you need the waiver letter.

The waiver for multiple filings is only a statement of explanation anyway, so your should write a statement explaining that while the foreign fiance(e) has had someone file a petition on her behalf before, this is the first and only I-129F petition you have filed.

Did the ex withdraw the first petition? He should.
