My wife would like to file a I-130 to petition for her daughter to come to the USA.

We got married before her daughter turned 18. Her daughter will be turning 21 this coming August.

My wife won't be able to apply for citizenship until after her daughter turns 21, so I am trying to figure out which of these would be the fastest method:

1 - I petition for my wife's daughter (my stepdaughter) since we got married before she turned 18 and it could be filed before she turns 21.

2 - My wife petitions for her daughter as a greencard holder before her daughter turns 21.

3 - My wife waits to become a US citizen later this year and petitions for her daughter after her daughter turns 21.

Thank you for your advice.

My wife would like to file a I-130 to petition for her daughter to come to the USA.

1 - I petition for my wife's daughter (my stepdaughter) since we got married before she turned 18 and it could be filed before she turns 21.

If you file the I-130 before her 21st birthday, then this would be an Immediate Relative case and she can get a visa in about a year.

If you file the I-130 after her 21st birthday, then this would be an F-1 family preference category case and it will take 6-7 years for a visa.

2 - My wife petitions for her daughter as a greencard holder before her daughter turns 21.

The daughter would most likely age out into the F2b category where it's a 7 years wait for a visa.

3 - My wife waits to become a US citizen later this year and petitions for her daughter after her daughter turns 21.

This would be an F-1 case and its 6-7 years for a visa.

Thank you for your advice.

You need to file the I-130 ASAP if you want her here quickly.
