Ok, so I was chatting with someone who works at US Customs at the Airport. We talked about the K3 and CR1 process.

My understanding has been that if I enter the US on a K3 Visa, I can stay, file my EAD and file AOS.

He said- if I enter on the K3, I would still have to go back to Montreal and finish the CR1 process.

What makes this whole thing frustrating is that everyone tells you something diferent. Now I am in a tizzy and don't know if I am correct about this, or if he is.

U are correct, but he is sort of corerect. If you did the cr-1 as well, you have the OPTION of going back todo the cr-1 interview in MTL instead of AOS'ing. One just has to choose which is their better option!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Never a dull moment, eh? You can come on K3 and adjust status. You can also come on K3 and go back to Montreal for the CR-1 interview. It's up to you. Which one is more efficient in terms of time and money?

I would definately prefer to go on K3 and AOS. Once I get back to the US, the rest can take as long as it needs to. We will be fine with that. He was so determined he was right- he made me mad. He kinda treated me like some dumb blonde. I have been working hard to understand this process and have come a long way since I started.

Pour me another glass of Beaujolais, Stacey, and let's compare notes, because my husband recently entered from Toronto on a K3 and we've filed for AOS.

The rules and forms seem to change on a monthly basis, which is why even an immigration attorney can't be up-to-date on all the latest changes!

Hang out here, get the information and real-life experiences, and move forward with your plan regardless of the pompous know-it-alls!

I pretty much ignore anything border guards or the mis-information 1-800 line tell me if it contradicts what I know.

I had a border official tell me that I could apply for a K1 for my husband before I was naturalized as a U.S. citizen.

A lot of them don't know what they are talking about, some of them do, but it won't benefit me in arguing with them, so I just thanked them for the advice :)

I would think depending where the cr-1 was, it would be easier to fly back and do the cr-1 interview. Guess one has to factor in travel costs, but less paperwork to send in.

Hi Stacey and all others in the same boat,I'm doing the same thing going to get to the U>S> and figure it out then the cr-1 letter stares at me on the desk. Once k3 is done I'll start figuring it all out with help from here good luck

I would LOVE to take Mel to Montreal. It is where I was born. The CR1 seems like it will be quite a long way off- I may try to talk to Mel and see if he would consider a trip there.

This one was in Calgary.

One guy at the Edmonton Airport told me when I was denied entry to the US in September- that once my I 130 was approved, I take it to Calgary, they stamp it and I can go. He said it would take about a month. He was very sweet, but obviously a total moron.

A trip to Montreal for two, including airfare, taxis to and from Dorval, hotel, meals, etc. can be quite costly. Although I love the city, it may not be the best choice, financially speaking, to go back for a CR-1 interview. We'll adjust status in New Jersey.

I'm glad we went back for the CR-1 interview in Montreal. You can always find good deals on travelocity or orbitz or whatever, and then make it into a romantic vacation to reward yourselves for all of the stress you've endured. It's a great city!

The best part is, once you're in the US, NO MORE IMMIGRATION HASSLES! (priceless) :dance:
